AN ACT to repeal and re-enact, with amendments, sub-section (i)
of Section 696 and sub sections (c) and (d) SUB-SECTION (C)
of Section 708 of Article 66C of the Annotated Code of Maryland
(1957 Edition), title "Natural Resources", sub-title "Oysters and
Clams", to change the definition of a natural oyster bed OR CLAM
BED, RELATING TO A SURVEY OF A SUBMERGED AREA
OF THIS STATE, RELATING TO LEASES OR NATURAL
OYSTER BARS OR CLAM BARS, and to change the applicable
law with respect to resurveys of State waters.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sub-section (i) of Section 696 and Sub sections (c) and (d)
SUB-SECTION (C) of Section 708 of Article 66C of the Annotated
Code of Maryland (1957 Edition), title "Natural Resources", sub-
title "Oysters and Clams", be and they are hereby repealed and re-
enacted, with amendments, and all to read as follows:
696.
(i) Natural oyster bar.—Any submerged oyster bar, reef, rock
or area represented as an oyster bar on the charts of the Oyster
Survey of 1906 to 1912, or amendments thereto, or any such area
which has been or shall have been declared by any circuit court to
be a natural oyster bar, or any area on which the Department of
Tidewater Fisheries has planted or shall have planted oysters or
shells [; all such areas, bars, rocks or reefs, being delineated on
charts in the office of the Department of Tidewater Fisheries].
Upon the completion of a resurvey of any submerged area of the
waters of the State under Section 708 of this Article to determine
the positions and extent of natural oyster bars, such completed resur-
vey, as far as the classification of bottoms is concerned, shall super-
sede the Oyster Survey of 1906 to 1912 or any decision of any cir-
cuit court rendered prior to the completed resurvey as to the area
resurveyed. NO NATURAL OYSTER OR CLAM BAR AS MAY BE
DEFINED IN THIS ARTICLE SHALL EVER BE LEASED
