Surgeons, and the Secretary of the Police Commissioner and his
assistants, from such graded lists. Candidates shall be considered and
shall be promoted or appointed, in the discretion of the Commissioner.
New appointments shall be made by the Commissioner from the first
twenty (20) names on any list. When such appointed list of twenty
(20) names is exhausted through appointment by the Police Com-
missioner a new list of twenty (20) names shall be supplied by the
Personnel Officer. In the case of promotions, the Personnel Officer
shall furnish to the Commissioner a list which shall contain [a name]
the names of all persons having a grade of seventy (70) EIGHTY-
FIVE (85) or better on the examination for each vacancy to be filled
[plus twenty (20) additional names]. Promotions shall be made by
the Commissioner, in his discretion, from such list. Applicants may
be removed from the nominated list by the Personnel Officer at any
time for cause as set out in Section 541 of this Article.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1961.

(House Bill 882)
AN ACT to add new Sections 444½, 459½ and 462½ to Article 81
of the Annotated Code of Maryland (1960 Supplement), title
"Revenue and Taxes", sub-title "State Tobacco Tax Act", to follow
immediately after Sections 444, 459, and 462, respectively; and to
repeal and re-enact, with amendments, Sections 438 (a), 442, 443,
448, 449, 455, 457, 462 and 463 (a) of said Article (1960 Supple-
ment), title "Revenue and Taxes", sub-title "State Tobacco Tax
Act", providing for labeling of vending machines and confiscation
of machines for violation, police powers of Cigarette Tax Unit
personnel and the disposition of confiscated property, amending
the State Tobacco Tax Act with relation to the acquisition and of
the fixation of stamps, to remove certain provisions from one sec-
tion to another, relating to fines and penalties, record keeping re-
quirements, search and seizure of vehicles and other property,
cigarettes shipped to Maryland residents from out-of-state and
clarification of appeals procedure, and generaly amending the
State Tobacco Tax Act.
Section 1. Be it enacted by the General Assembly of Maryland,
That new Sections 444½, 459½ and 462½ be and they are hereby
added to Article 81 of the Annotated Code of Maryland (1960 Sup-
plement), title "Revenue and Taxes", sub-title "State Tobacco Tax
Act", to follow immediately after Sections 444, 459 and 462, respec-
