of the rules and regulations adopted by the Board of Pharmacy in ad-
ministering the provisions of this section, shall be deemed guilty of
a misdemeanor and upon conviction thereof, fined not more than
fifty dollars ($50) for each offense; and each and every day such
violation continues shall constitute a separate and distinct offense;
and upon conviction of the holder of a permit it shall forthwith be
revoked and become null and void.

Sec. 2. And be it further enacted, That this Act shall take effect on
June 1, 1961.

CHAPTER 651

(Senate Bill 163)

AN ACT to repeal Section 469 of Article 27 of the Annotated Code
of Maryland (1960 Supplement), title "Crimes and Punishments",
sub-title "Refuse—throwing or dumping; dumps, junk yards, etc.",
and to add a new Section 122A to Article 25 of said Code (1957
Edition), to follow immediately after Section 122 thereof, and to
be under the new sub-title "Junk Yards", repealing a section in
the criminal laws concerning the maintenance of certain junk
yards and public dumps in certain counties of Maryland, said
section having been declared unconstitutional, and enacting a new
authority for the County Commissioners or County Council of any
county in the State to regulate the licensing, control, location and
maintenance of certain junk yards, public or private dumps, auto-
mobile junk yards or outdoor places where old motor vehicles are
stored in quantity or dismantled, and lots on which refuse, trash or
junk is deposited, and relating generally to the licensing, control,
location and maintenance of such places within the several counties,

Whereas, in the Case of State v. Greenberg, 221 Md. 471 (157 A
2.d 420) decided by the Court of Appeals in the year 1960, the Court
of Appeals declared unconstitutional the provisions of Section 469
of Article 27 of the Code, as the same was last amended in 1959; and

Whereas, it is desirable to remove this section from the Code
since it no longer is effective under this court decision; and

Whereas, at the same time, the several Boards of County Com-
missioners and County Councils in the State desire and need power
to regulate and control the junk yards, automobile junk yards and
similar places at which trash, junk, refuse and old automobiles may
be collected; now, therefore,

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 469 of Article 27 of the Annotated Code of Maryland
(1960 Supplement), title "Crimes and Punishments", sub-title
