1797.

XXV. And be it enacted, That the property of each affeffor fhall be valued

by the commiffioners of his county, or of the city of Baltimore, as the cafe may
be, or any one of them, on or before the twentieth day of May next, in the
fame manner as the real and perfonal property of other perfons by this act is di-
rected to he eft i mated by the affeffors.

LXXXIX.

Affeffors pro-
perty to be

valued, &c.

XXVI. And be it enacted, That the commiffioners of the feveral counties
fhall direct their clerk to enter in a book to be provided for that purpofe, an ac-
curate and fair account of all the real and perfonal property within their county,
and the valuation thereof as returned by the affeffors, or as corrected by them,
with an alphabetical lift of the owners or perfons chargeable with the affeffment
of fuch property.

XXVII. And be it enacted, That the clerk to the commiffioners in each
county fhall, on or before the firft Monday of July next, make out from the af-
feffors certificates, and the corrections thereof (if any) by the commiffioners, a
fummary account or lift, (in columns,) in which fhall be expreffed the number
of flaves of each defcription within this act, the weight of plate, and the value
of each of the faid fpecies or kind of property, and all the other perfonal pro-
perty, and the value thereof, in each diftrict, and the whole value in each diftrict
extended, and the amount of each column, and fhall lay the fame before the
commiffioners, who, after correction thereof, if neceffary, fhall fign and enclofe
the fame, endorfed for the public fervice, to the clerk of the houfe of delegates,
and fhall, within ten days thereafter, under the penalty of fifty pounds current
money on each commiffioner, deliver the fame to the fheriff of their county, to
be by him forwarded as public letters, and under the like penalty, and fhall alfo
deliver to the clerk of his county court a duplicate thereof, to be lodged among
the records of the faid county, in eight days thereafter; and the clerk of the
houfe of delegates fhall enter the faid fummary account in a book to be provided
for the purpofe, and keep the original in his office, and, on the fecond day of
the next meeting of the general affembly, he fhall lay the fame before the houfe
of delegates, for the infpection of the members.

XXVIII. And be it enacted, That if any of the days appointed by this act
for the performance of any of the duties hereby required fhall happen to be a
Sunday, then fuch duties fhall be performed on the day following.

XXIX. And be it enacted, That if any fuit fhall be brought againft any per-
fon for any thing done in purfuance of this act, the fuit fhall be commenced
within fix months after the fact committed, and the defendant in any fuit fhall
plead the general iffue, and give this act and the fpecial matter in evidence, and
that the fame was done in purfuance and by authority of this aft; and if it fhall
appear fo to be done, or if any fuit fhall be brought after the time limitted, then
the jury fhall find for the defendant; and if the plaintiff fhall become nonfuit,
or fuffer a difcontinuance, or if a verdict fhall pals, or, upon demurrer, judge-
ment fhall be given, againft him, the defendant fhall recover treble cofts, and
have fuch remedy for the fame as any defendant hath for cofts of fuit in other
cafes at law.

XXX. And be it enacted, That from and after the paffage of this act, every
perfon who fhall or may remove to any county within this ftate from the county
in which his property hath or may have been affeffed, or from any other place
without this ftate, and whofe perfonal property hath not or may not have been
affeffed in the county to which he hath or may remove, every fuch perfon fhall,
and he is hereby directed, when required by the collector of the county, or his
deputy, in which his perfonal property, or the property under his care and
management, doth or may lie, to give to fuch collector, or his deputy, a full
and particular account of his perfonal property in the faid county, and of all
perfonal property in his poffeffion, or under his care and management, liable to
be affeffed, and which before the time of fuch requeft fhall not have been affeffed
in the faid county, and the name of the perfon to whom the fame belongs, and.
