C H A P.

LXXXIII.

ments, ordinary, retailers, marriage, hawkers and pedlers licence, and which
fifteen per cent, fo collected, fhall be the only fund out of which the agent fhall
draw his commiffion of three per cent, for collecting the facie; provided that the
faid agent fhall not be entitled to any commiffion upon the monies arifing from
fines, forfeitures, amerciaments, ordinary, retailers, marriage, hawkers and ped-
lers licences, unlefs in cafes where the fame fhall not be paid by the fheriffs and
clerks refpectively to the treafurer within one month after the time prefcribed by
law, and unlefs the faid agent fhall thereafter receive the fame from the faid of-
ficers refpectively, and the fame pay to the faid treafurer.

XXIII. And be it enacted, That the faid agent, before he enters upon the exe-
cution of the duties of this act, fhall give bond to the ftate, before the governor
and council, in the penalty of fixty thoufand dollars, with fuch fecurity as the go-
vernor and council fhall approve, for the faithful performance of the faid duties,
which bond fhall be lodged with the treafurer of the weftern fhore, and fhall alfo
fake an oath before the chancellor, that he will well and faithfully difcharge the
duties as agent Under the act, entitled, An act to appoint an agent for the year one
thoufand feven hundred and ninety-eight, to the beft of his fkill and judgment,
the certificate of which oath fhall be annexed to, or endorfed on, the faid bond.

XXIV. And be it enacted, That if the faid agent fhall not accept his ap-
pointment, or if after his acceptance he fhall not give bond, and take the oath
aforefaid, before the firft day of February next, or fhall die, the governor and
council are hereby authorifed and requefted to appoint a fit and proper perfon in
his place, who fhall have and execute all the authorities and powers veiled in the
faid William Marbury by this act, fuch perfon firft giving fecurity, and taking
the oath aforefaid.

C H A P. LXXXIV.
A Supplement to the act, entitled, An act refpecting the roads of
Somerfet and Worcefter counties.
WHEREAS, through miftake, the act, entitled, An act relating to
public roads in this ftate, and to repeal the acts of affembly therein
mentioned, and the fupplements thereto, fo far as relates to Somer-
fet county, was omitted to be repealed in the act, entitled, An act refpecting the
roads of Somerfet and Worcefter counties, paffed at November feffion, feventeen
hundred and ninety-fix; therefore,

Parts of acts
repealed.

II. Be it enacted, by the General Affembly of Maryland, That the act of
affembly paffed at November feffion, one thoufand feven hundred and ninety-
four, entitled, An act relating to public roads in this ftate, and to repeal the acts
of affembly therein mentioned, and the fupplements thereto, fo far as relates to
Somerfet county, be and the fame is hereby repealed.

Acts extend-
ed, &c.

III. And be it enacted, That an act paffed at October feffion, feventeen hun-
dred and fifty-three, entitled, An act for repairing public roads in this province,
and the fupplement thereto, and the feveral claufes and provifions thereof, be
and the fame are hereby extended to the county of Somerfet, to all intents and
purpofes, any law or cuftom to the contrary notwithstanding.

Perfons ex-
empt, &c.

IV. And be it enacted, That in Somerfet county all perfons under fixteen and
upwards of fifty years of age, fhall be exempt from working on the public roads
of faid county, any law to the contrary notwithstanding.

highway.

WHEREAS fundry inhabitants of Worcefter county have represented
to this general affembly, that a certain road in faid county, leading
