for civil defense (except the Director) in the classified service of the
State. During the effective period of any such regulation) the said
employees and officers shall be subject to certain of the rights, duties,
privileges, and responsibilities of Article 64A of the Annotated Code,
title "Merit System", with the particular board of county commis-
sioners or county council, or the Mayor
of Baltimore City, as the ap-
pointing officer thereunder; but the provisions of this sentence shall
not be construed or applied to remove from the particular board of
county commissioners or county council or from the Mayor and City
Council of Baltimore power to establish and regulate the compensa-
tion, vacation allowance, and sick leave of all such employees and
officers in the respective political subdivisions.

SEC. 2. And be it further enacted, That a new Section 9B be and
it is hereby added to Article 64A of said Code (1957 Edition and
1961 Supplement), to follow immediately after Section 9A thereof,
and to read as follows:

9B. On and after June 1, 1962, as provided in Section 235 (b) of
Article 41 of this Code, all positions in the State Civil defense or-
ganization, except that of Director, are included within the provi-
sions of the classified service and subject generally to all privileges
and responsibilities provided in this Article.

SEC. 3. And be it further enacted, That any person whose posi-
tion is to be included in a merit system or classified service under the
provisions of this Act and who has been employed in such position
since December 31, 1960, shall be retained therein and acquire merit
system and classified service status at a salary scale not less than
that paid to him during such period subject only to his taking and
passing a qualifying examination therefor administered by the Com-
missioner of Personnel in cooperation with the Civil Defense Agency.
Any person holding such a position on the effective date of this Act
who has held the position for a period less than that extending from
December 31, I960, shall be eligible to become a member of the classi-
fied service or merit system in the usual manner of taking an exami-
nation and of being placed upon and being selected from a list of
qualified applicants.

SEC. 4. And be it further enacted, That this Act shall take effect
June 1, 1962.
