Article 88B of the Annotated Code of Maryland (1957 Edition),
title "State Police", sub-title "Pensions" amending the laws con-
cerning the old Retirement and Pension System of the Maryland
State Police in order to change the allowance payable to surviving
widows and certain minor children of members of the said system
who die either before or after retirement, and in order to change
the conditions under which such allowances are paid.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 34 of Article 88B of the Annotated Code of Maryland
(1957 Edition), title "State Police", sub-title "Pensions", be and it
is hereby repealed and re-enacted, with amendments, to read as
follows:
34.
If a member of the State Police becomes physically incapable of
performing his duties and such disability is the result of an accident
or injuries occurring in the course of duty or is the result of sickness,
accident or disease contracted in the course of duty and if such mem-
ber has been in the Department for ten years or more, then he shall
be entitled to the same retirement pension as provided for in Section
31, provided that such employee be found, after medical examination
given by a Medical Board of three physicians, consisting of the
Medical Examiner of the Department of Maryland State Police and
two other physicians to be selected by the Board of Trustees of the
Retirement and Pensions System of the Maryland State Police and
acceptable to the State Police Department employee concerned, to
be physically incapable of performing his duties.
[If any member of the Department of Maryland State Police dies
either before or after retirement from the service on a pension,
leaving a widow or child or children under the age of sixteen (16)
years, the widow shall receive a pension from said fund in an amount
not to exceed sixty dollars ($60. 00) per month until her death or
remarriage, and each child under the age of sixteen (16) shall re-
ceive a pension not to exceed ten dollars ($10. 00) per month until
death or reaching the age of sixteen (16) years. No widow, child
or children resulting from any marriage contracted subsequent to
retirement of the husband or father from the Department shall re-
ceive any relief under the provisions of this sub-title. ]
// any member of the old Retirement and Pension System of the
Maryland State Police dies before retirement, or after retirement
from service on a pension, there shall be paid to his widow, if any,
and to continue during her widowhood, a pension equal to twenty-five
percentum of his annual remuneration. If the member does not leave
a surviving widow but there is or are a surviving child or children,
any or all of whom are under the age of 18 years, the pension shall
be paid to the surviving child or children who are under the age of
18 years, in equal amounts to each. Any payments made to a widow
under this section shall terminate on either the death or remarriage
of the widow. In either event if there is or are a child or children
of the deceased member, who are under the age of 18 years, the pay-
ments under this section shall continue to such child or children in
equal amounts. Payments under this section to the widow of a mem-
ber shall continue for the duration of her natural life, unless she re-
