AN ACT to add a new Section 32 to Article 16A of the Annotated
Code of Maryland (1957 Edition), title "Civil Defense", (said
Article having been created by legislation enacted by the General
Assembly of 1962), said new section to follow immediately after
Section 31 thereof, and to be under the new sub-title "Emergency
Powers of Administration", authorizing the Governor to exercise
administrative and executive powers on behalf of a Board of
County Commissioners if by reason of a military or warlike
catastrophe a majority of the members of any Board of County
Commissioners are not present and available for either a tem-
porary or an indefinite period; and providing that these powers
are effective only during the period covered by an official procla-
mation of the Governor declaring the existence of a civil defense
emergency or disaster area, actual or threatened.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That a new Section 32 be and it is hereby added to Article 16A of
the Annotated Code of Maryland (1957 Edition), title "Civil De-
fense", (said Article having been created by legislation enacted by
the General Assembly of 1962), said new section to follow immedi-
ately after Section 31 thereof, to be under the new sub-title "Emer-
gency Powers of Administration", and to read as follows:
Emergency Powers of Administration
32. If, by reason of any military or warlike catastrophe, a
majority of the members of any board of county commissioners are
killed, or are sick, incapacitated, missing, or otherwise unavailable
for either a temporary or an indefinite period, the Governor may
exercise any of the administrative and executive powers provided by
law for that board of county commissioners, until such time as a
number of county commissioners sufficient to operate the county gov-
ernment are appointed and qualify. The powers provided in this
section exist and may be exercised only during the effective period
of an official proclamation by the Governor, declaring a portion or
all of the county to be within a civil defense emergency or disaster
area, actual or threatened.
SEC. 2. And be it further enacted, That this Act shall take effect
June 1, 1962.
