The Bill provides that in a suit filed against an uninsured motorist,
who is a resident of the State, service can be made by publication
after twice returned "non-est".

The Attorney General has advised me by letter, dated March 22,
1962, that his office had reviewed House Bill 64 and recommended
that I veto the Bill for the following reasons:

"1. There is no proper standard in the bill to determine who is
an owner or operator of an insured motor vehicle.

2. The Bill does not provide for proper service upon an owner or
operator of an uninsured motor vehicle for in personam jurisdiction.

3. That the bill possibly provides for unconstitutional discrimina-
tion against any person arbitrarily judged to be uninsured. "

In view of the Attorney's recommendation, I feel it necessary to
veto House Bill 64.

House Bill No. 64—By Mr. Resnick:

AN ACT to add new Section 115A (j) to Article 66l/2 of the An-
notated Code of Maryland (1961 Supplement), title "Motor
Vehicles", sub-title "Civil Liability", to follow immediately after
Section 115A (i) thereof, providing generally that in suits com-
menced against certain persons owning or operating an uninsured
motor vehicle within the State of Maryland, such persons may
be notified of the accidents against them through process of
publication and are thereby submitted to the personal jurisdic-
tion of the court, relating generally to judgments against such
persons and the Unsatisfied Claim and Judgment Fund, and
matters incident thereto.

The Speaker put the question: Shall the bill pass notwithstanding
the objections of the Executive?
