"Justices of the Peace", sub-title "Trial Magistrates System, " of
the Annotated Code of Maryland (1957 Edition), to provide for
the appointment of an additional substitute judge for the People's
Court for Montgomery County.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That sub-section (d) of Section 98 of Article 52 of the Annotated
Code of Maryland, (1957 Edition), title "Justices of the Peace",
sub-title "Trial Magistrates System, " is hereby repealed and re-
enacted, with amendments, to read as follows:
98.
(d) As of June 15, 1955, the county council of Montgomery
County shall appoint a substitute judge of the People's Court for
Montgomery County. Such appointee shall serve as such until the
first day of May in the year 1958, or until his successor is appointed
and qualifies. Thereafter, as of May 1 every four years the county
council of Montgomery County shall appoint a substitute judge of the
People's Court to fill the term then expiring, which appointee shall
serve for four years dating from May 1 of the year of appointment or
until his successor is appointed and qualifies. As of the first day
of May in the year 1962, and as of May 1 every four years thereafter,
the county council shall appoint a second substitute judge to serve a
term of four years or until his successor is appointed and qualifies.
The provisions of sub-section (b) of this section, prescribing qualifi-
cations for the judges of said court, shall apply to any person ap-
pointed as substitute judge. [The] A substitute judge shall be paid
and have such duties as hereinafter provided.
SEC. 2. And be it further enacted, That sub-section (g) of Section
119 of Article 52 of the Annotated Code of Maryland, (1957 Edition),
title "Justices of the Peace", sub-title "Trial Magistrates System, "
is hereby repealed and re-enacted, with amendments, to read as
follows:
119.
(g) Montgomery County. —[The] A substitute judge of the
People's Court of Montgomery County shall receive as compensation
$600. 00 per year in addition to the pro rata amount which is paid to
a full-time judge of the People's Court for the time such substitute
actually spends sitting as a substitute. [The] A substitute judge
shall serve in the event of the temporary absence or inability of a
judge of the People's Court, including the People's Court judge for
juvenile causes, and shall sit in such judge's place and stead during
the period of his absence or inability, and shall have the same power
and authority and be subject to the same duties and responsibilities
as the judge for whom he is sitting. Upon request by any judge of the
People's Court, [the] a substitute judge may sit at such time and place
as is necessary to relieve a crowded docket. The salary of the judge
causing a substitution shall not be diminished on account of compensa-
tion paid to such substitute.
SEC. 3. And be it further enacted, That this Act is hereby
declared to be an emergency measure and necessary for the immediate
preservation of the public peace, health and safety and for the
