ing oath, or affirmation, to wit: "I, A. B. do fwear, or affirm, that I will
" honeftly and faithfully eftimate and value the damage and injury fuftained by
"C. D. by opening and extending the road from Pratt-ftreet aforefaid, (as the
" cafe may be,) through the land of C. D. in purfuance of this ad," and fhall
return the eftimation of damages by them fo affeffed to the clerk of Baltimore
county, under their hands and feals; and the estimation of damages by them fo
affeffed, or a majority of them, fhall be final and conclufive.

LVIII.

IV. And be it enacted, That all damages, cofts and expences, attending the

laying out, extending and confirming, the faid road, fhall be paid by the petiti-

oners for the fame.

V. And be ft enacted, That the commiffioners aforefaid fhall not have power
to open the faid road through the land of any proprietor without his or her con-

fent, until the expiration of twelve months next after the making of the award
aforefaid, or in cafe of the intervention of a jury until the expiration of twelve
months after the return as aforefaid of their inquifition, and moreover until the
damages afcertained as aforefaid fhall have been paid, or tender thereof made.

An ACT to incorporate an infurance company in Baltimore-town.

WHEREAS fundry perfons have formed themfelves into a fociety for
the infurance of fhips and merchandise at lea, and have prayed to be
incorporated by law: And whereas it appears to this general affem-
bly, that the granting of the prayer aforefaid will be advantageous to the com-
mercial and agricultural intereft of this ftate,
