two affociate juftices thereof, and in cafe of death, ficknefs, abfence, removal,
refignation or difqualification, of one of the affociate juftices, the other fhall call
in two juftices of the peace, who fhall, with him, judge of the fufficiency of
the fecurities offered by the fheriff, and atteft the execution of the faid bond;
and that all fheriffs bonds fhall hereafter be taken according to the form follow-
ing; that is to fay, "Know all men by thefe prefents, that we, ______and
" of county, in the ftate of Maryland, are held and firmly bound
" unto the ftate of Maryland in the full and juft fum of ten thoufand pounds
" current money, to be paid to the faid ftate, or its certain attorney; to the
" which payment well and truly to be made and done, we bind ourfelves, our
" heirs, executors and adminiftrators, jointly and feverally, firmly by thefe pre-
" fents: Sealed with our feals, and dated this —— day of------, in the year
" • The condition of the above obligation is iuch, that if the above
" bounden--------, as fheriff of------county, do and fhall well and faithfully
" execute the fame office in all things appertaining thereto, and fhall alfo render
" to the feveral officers within this ftate a juft and true account of all fees placed
" in his hands for collection, within the time limitted by law, and fhall alfo well
" and truly pay all fums of money received by him, and alfo collecl: and pay all
" public dues, fines and forfeitures, which are due or belonging to the ftate, and
" fhall alfo well and faithfully execute and return all writs, procefs and warrants,
" to him directed and delivered, and fhall alfo pay and deliver to the peribn or
" perfons entitled to receive the fame, all fum or fums of money, tobacco, goods,
" chattels or property, by him levied, feized or taken, agreeably to the directions
" of the writ, procefs or warrant, under which the fame fhall have been levied,
" feized or taken, and alfo fhall keep and detain in fafe cuftody all and every per-
" fon or perfons committed to his cuftody, or by him taken in execution, or
" who fhall be committed for the want of bail, without fuffering them, or any
" of them, to efcape or depart from his cuftody, and fhall alfo fatisfy and pay
" all judgments which fhall or may be rendered againft him as fheriff, and fhall
" alfo well and truly execute and perform the feveral duties required of or impofed
" upon him by the laws of this ftate, then this obligation to be void and of none
" effect, otherwife to remain in full force and virtue in law;" which bond fhall
be attefted by the judge or juftices before whom the fame fhall be taken, and de-
livered by the faid judge or juftices, immediately after the execution thereof, to
the clerk of the county court, to be by him recorded, and a copy thereof, cer-
tified under the feal of the court, fhall be good evidence to prove the execution
of fuch bond in any court of this ftate; and the clerk of the feveral county courts
of this ftate are hereby required, after recording the fame, to tranfmit an attefted
copy of faid bond to the clerks of the general courts of the refpective fihores of
this ftate, to be lodged with them for fafe cuftody.

CHAP.

LIV.

IX. And be it enacted, That it fhall and may be lawful for the clerks of the
feveral county courts, and they are hereby authorifed and required, on applica-
tion of the plaintiff or plaintiffs in any judgments of their courts refpectively,
upon return of nulla bona by the fheriff or coroner on a fieri facias iffued in the
county where fuch judgment hath been, or hereafter may be obtained, to iffue
executions on faid judgments againft the goods and chattels, lands and tenements
of any defendant, lying and being in any other county than that in which fuch
judgment was or fhall be obtained, which execution fhall be directed to. and
ferved by, the fheriff or coroner, as the cafe may require, of the county in which
fuch goods and chattels, lands and tenements, may be and lie, and returned to
the court of the county of which he is fheriff or coroner; and it fhall be fufficient
for the plaintiff, to entitle himfelf to the benefit of fuch execution, to produce,
before the court to which the fame fhall be returnable, a fhort copy of the judge-
ment by him obtained, attefted by the clerk of the court before which the fame
is had.

X. And be it enacted, That in every fuit which fhall or may hereafter be or-
dered or directed on any adminiftration, teftamentary, infpectors, collectors, or
fheriff's bond, the clerk fhall, and he is hereby directed, before the iffuing of the
writ, to endorfe thereon the name or names of the party or parties at whofe in-
