C H A P.

LXIX.

be paid: When any witnefs may be or refides in any other county in this ftate,
the aforefaid courts fhall feverally have full power to iffue fubpoena for fuch wit-
nefs, directed to the fheriff of the county where fuch witnefs fhall refide, and
fuch fheriff fhall ferve and return the fame; and if any perfon fo fummoned fhall
neglect to attend, attachment may iffue againft him, directed as aforefaid, and by
virtue thereof the fheriff fhall be obliged to have the body of fuch witnefs before
the court iffuing fuch attachment, and in cafe of neglect or delay by fuch fheriff
to ferve and return fuch fubpoena or attachment, and to have the body of fuch
witnefs, fuch fheriff may be fined by the court iffuing fuch procefs; and every
procefs and fubpoena fhall be forwarded by the fheriff of the county: The mayor
fhall have power to naturalize foreigners in the fame manner as any judge of the
general court, according to the act, entitled, An act for naturalization, paffed at
July feffion, in the year one thoufand feven hundred and feventy-nine, or any
other act of naturalization which may be paffed, and alfo, if fo authorifed by
congrefs, to naturalize foreigners agreeably to the laws of congrefs; and the cer-
tificate of the mayor, under the feal of the corporation, fhall be evidence of fuch
naturalization in all courts of juftice, and thereout; and the mayor fhall return
lifts of all perfons naturalized by him to the general court, and city civil court,
there to be recorded; and certificate of fuch return fhall be evidence of natu-
turalization: The mayor, recorder, aldermen and electors, fhall not be fum-
moned on any juries out of the county: The mayor fhall be keeper of the
feal of the corporation, and the chief confervator of the peace; he may lay
before the common-council, from time to time, his opinion reflecting ordi-
nances neceffary to be paffed, amended or repealed, he may call upon any
officer for his opinion in writing, relating to the duties of his office, and up-
on all officers intrufted with the receipt or expenditure of public money for
a ftatement of their accounts, as often as he may judge neceffary; he fhall
fee that the ordinances are duly and faithfully executed, and fhall report an-
nually to the common-council a general ftate of the city, and its progrefs in
trade, arts, manufactures and fciences, with a general account of the money re-
ceived and expended: The members of the common-council, mayor, recorder,
aldermen, electors, judges, and clerks of elections, and all officers of the corpo-
ration, before entering upon the execution of their respective offices, duties or
trufts, fhall take the following oath, or affirmation: " I ———— do folemnly
" fwear, or affirm, that I will faithfully execute the office of ———— ;" but no
religious teft fhall ever be required as a qualification in any voter, or to any office
or appointment, neither fhall any other difqualification or difability to hold and
execute any office under this act, or any ordinances of the common-council, than
is mentioned in this act, be ever created by the legiflature of this ftate, nor any
ordinance of the faid common-council: The aldermen, or any three or more of
them, fhall be judges of the elections for delegates, and electors of fenators, to
the general affembly: The precincts fhall not exceed one mile beyond the limits
of the city, including all waters within the faid diftance; and the common-
council fhall from time to time caufe the fame to be defined by meets and bounds :
The inftitution of town commiffioners, ftreet commiffioners, and port wardens,
fhall ceafe and determine as foon as this corporation and conftitution of govern-
ment fhall be in force and operation, but the common-council fhall enjoy all the
rights, and may provide for the exercife of all powers and authorities, now vefted,
or that may be vefted, in the faid town commiffioners, ftreet commiffioners, and
port wardens, but no rights acquired under the acts of the aforefaid boards fhall
be annulled; and immediately upon the confirmation of this corporation, the
records, papers, proceedings, monies, accounts, and all other matters and things
appertaining to the aforefaid town commiffioners, ftreet commiffioners, and port
wardens, fhall be forthwith lodged and depofited with fuch perfon or perfons as
fhall be appointed to receive the fame; and all acts of the legiflature now in
force, or that fhall be in force previous to the confirmation of this act, touching
the police or government of Baltimore-town, or for regulating any of its internal
concerns, fhall ceafe and determine, and are hereby repealed, as foon as the faid
corporation fhall provide for fimilar regulations, and any appropriations of money
contained in any of the faid acts, for the ufe of the faid town, are hereby vefted
in the faid corporation: If at any time through overfight, mifapprehenfion, and
