refpective rates or fares, and to make all neceffary regulations refpecting the fame;
to reftrain or prohibit public gaming, and to provide for licenfing theatrical and
other public amufements; to erect a houfe of correction; to provide for fettling
all complaints between matters, apprentices and fervants; to provide for fettling
complaints between mariners, and between citizens and mariners; to erect and
repair bridges, pave and keep in repair the ftreets, lanes and alleys; to make and
keep in repair all neceffary drains and fewers, and to pafs all regulations neceffary
for the prefervation of the fame; to fix the days for all elections not herein fixed ;
to regulate and eftablifh infpections, not now regulated or eftablifhed by ads of
affembly, fubject to the future ads of the general affembly; to regulate and fix
the affize of bread; to provide for the fare keeping and prefervation of the ftand-
ard weights and meafures, fixed by congrefs, and for the regulating thereby all
weights and meafures ufed within the city and precincts; to regulate party walls ;
to erect and regulate markets; to eftablifh and regulate notaries and their fees; to
eftabifh and regulate the fees of the mayor, recorder and aldermen; to provide
for licenfing, (with the confent of the Maryland infurance fire-company,) fixing
the rates, and regulating, the fweeping of chimnies within the city, and the fweep-
ing of any chimnies in the precincts, by the negled of which the fafety of the
city may be endangered, and to afcertain the width of thofe to be built; to regu-
late and eftablifh the fize of brick; to erect and regulate pumps in the ftreets,
lanes and alleys; to appropriate and colled all fines, penalties and forfeitures,
arifing under this corporation; to impofe and colled fines and penalties, and lay
and collect direct and indirect taxes and impofitions, except as before excepted ;
to carry into execution the aforefaid powers, and all other powers herein vefted,
and to pafs all ordinances neceffary and proper to give effect and operation to the
aforefaid powers, and all other powers vefted in this corporation and conftitution
of government; but no goods, wares or merchandife, which have paid, or may
be liable to pay, duties to the United States, nor raw materials for manufactures,
nor materials manufactured, in the poffeffion of the manufacturer, nor the work-
ing tools of mechanics, nor property in the precincts, fhall be included in any af-
feffment: No perfon fhall be reftrained by the common-council in the exercife or
enjoyment of any profeffion, right, trade or bufinefs, farther than is exprefsly pro-
vided for by this act: The mode of trial in all profecutions for fines, penalties
or forfeitures, in confequence of this ad, may be prefcribed by the common-
council, fubject to the future regulations of the general affembly: No money
fhall be drawn from the city treafury but in confequence of the act of the com-
mon-council: The mayor fhall nominate, and with the concurrence of the coun-
cil of electors, appoint the recorder and aldermen, and all officers created by the
laws of this corporation: There fhall be one alderman appointed in each ward, a
refident thereof, but the number of aldermen may be increafed by an ordinance
of the common-council whenever the growth of the city, or other circumftances,
may render an increafe neceffary: The recorder and aldermen fhall be appointed
and commiffioned during good behaviour, but the commiffion of any recorder or
alderman may be revoked or annulled on conviction of mifbehaviour, on indict-
ment in the general court for the weftern fhore; and all other commiffions may
be revoked on conviction of partiality, corruption, or other mifbehaviour in office,
on indictment in Baltimore county and city criminal court: The mayor, recorder
and aldermen, are hereby feverally inverted with the powers of juftices of the
peace, and fhall have jurifdiction as fuch within the bounds of the city, and the
precincts thereof, and fhall take the oath of juftice of the peace, or affirm, as the
cafe may be: The recorder, and two of the aldermen, to be appointed and com-
miffioned as his affociates by the mayor, fhall hold and conftitute a court for the
trial of all felonies, or other crimes, offences or mifdemeanors, committed with-
in the bounds of the corporation, or within Baltimore county, and not particu-
larly by a law of the ftate direded to be tried in the general court, and all fuch
felonies, crimes, offences, mifdemeanors and proceedings, fhall be tried, heard
and determined, before the faid court, and not in Baltimore county court; and
the faid court fhall be called Baltimore County and City Criminal Court, and no
indictment found therein fhall be removed to "the general court at the inftance of
the party profecuted, without the leave of the faid court, or the order of the ge-
neral court, or fome one of the judges thereof: At the firft feffion of the faid
