to King-Tammany-ftreet, from thence to Chatham-ftreet, and from thence to
Calvert-ftreet, and that, by opening the faid ftreets, nearly a direct communica-
tion with the aforefaid market will be obtained; and this general affembly think-
ing the prayer of the faid petitioners reafonable,

CHAP.
XXVII.

II. Be it enacted, by the General Affembly of Maryland, That Stephen Wil-
for, Charles Crookfhanks, Hercules Courtenay, John Holmes and John Mickle,
or any three of them, fhall be and they are hereby appointed commiffioners to lay
out and open the following ftreets in Baltimore-town, of the width of forty feet;
that is to fay, from Fayette-ftreet, in Howard's Addition to the faid town, to
King-Tammany-ftreet, from thence to Chatham-ftreet, and from thence to Cal-
vert-ftreet; and the faid ftreets, when fo laid out and opened, and the valuation
and affeffment herein after directed to be made fhall have taken place, fhall be
deemed and taken, and are hereby declared to be, a public ftreet and highway for
ever thereafter; and the faid commiffioners are hereby directed to return a plot,
afcertaining the extent and limits of the faid ftreet when fo extended and opened,
to the clerk of Baltimore county court, who fhall receive and file the fame as
part of the plot of Baltimore-town.

III. And be it enacted, That the faid commiffioners, or any three or more of
them, after having given ten days public notice thereof by advertifement in the
Maryland Journal, fhall proceed to affefs and value what damages fhall be fuf-
tained by any perfon or perfons whatfoever, by reafon of extending the aforefaid
ftreets, taking all benefits and inconveniences into confideration, and fhall
return the fame, under their hands and feals, to the clerk of Baltimore county
court.

IV. And be it enacted, That the faid commiffioners, or any three of them,
after having given public notice as aforefaid, fhall meet and take into confidera-
tion what benefit the property of each individual fhall derive from extending the
aforefaid ftreet, and fhall declare what fum of money each individual, fo benefit-
ed, fhall reflectively contribute and pay towards compenfating the perfons injured
by extending and opening the faid ftreet, and the names of the perfons, and the
fums which they fhall be obliged to pay, fhall be returned, under their hands and
feals as aforefaid, and filed with the faid clerk; and the perfon or perfons bene-
fited by opening the faid ftreets, and affeffed as aforefaid, fhall respectively pay
intereft on the fums with which fhall be affeffed, at the rate of fix per cent, from
the time limitted for the payment thereof.

And confider

V. And be it enacted, That in cafe the faid commiffioners fhall neglect or re-
fufe to affefs and value the benefits and damages fuftained by reafon of opening the
faid ftreet on or before the firft day of May next enfuing, the fheriff of Baltimore
county fhall fummon feven freeholders of Baltimore-town, not interefted in the
premifes, who, being fworn to affefs and value the fame, fhall proceed agreeably
to the directions of this act.

VI. And be it enacted, That the fums of money affeffed and charged to each
individual benefited by extending and opening the aforefaid ftreets, fhall be a lien
upon and bind all the property fo benefited thereby to the full amount thereof.

VII. And be it enacted, That in cafe the perfons injured by opening and ex-
tending the faid ftreets fhall not be paid the damages by them refpectively fuf-
tained, and affeffed as aforefaid, within fix: months after the fame fhall be afcer-
tained, the faid commiffioners, or the furvivors of them, fhall be and they are
empowered and required to inftitute a fuit, in Baltimore county court, for the re-
covery thereof in which it fhall be fufficient to declare for money had and re-
ceived, and this act, and the proceedings under the fame, fhall be evidence to
fupport fuch action or actions, and fhall apply the money recovered towards fatif-
fying the individuals injured by extending the faid ftreets, or to fuch perfons as
fhall pay, or give bond to fecure them.
