CHAPTER 430
(Senate Bill 360)

AN ACT to repeal Sections 6, 7 and 9 of Article 66C of the Anno-
tated Code of Maryland (1957 Edition), title "Natural Resources",
sub-title "In General", sub-heading "Department of Tidewater
Fisheries", and to enact new Sections 6, 7 and 9 in lieu thereof,
to stand in the place and stead of the sections so repealed, to
abolish the Commission of Tidewater Fisheries and to create in
lieu thereof a Department of Tidewater Fisheries administered by
a Commission and a Director, to provide for their terms, salaries,
powers and duties, the Department to have the jurisdiction now
exercised by the Commission of Tidewater Fisheries, to provide
for the supervisory powers of the Department, regulation and
control over fisheries, oysters and clams and the power of the
Department to make rules and regulations concerning fisheries,
oysters and clams, and relating generally to fisheries, oysters and
clams in the State.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 6, 7 and 9 of Article 66C of the Annotated Code of
Maryland (1957 Edition), title "Natural Resources", sub-title "In
General", sub-heading "Department of Tidewater Fisheries", be and
they are hereby repealed, and that new Sections 6, 7 and 9 be and
they are hereby enacted in lieu thereof, to stand in the place and
stead of the sections so repealed, and all to read as follows:

6. There is hereby created a State Department to administer the
laws relating to the conservation and rehabilitation of tidewater fish-
eries. The Department is to be known as the Department of Tide-
water Fisheries. It shall be supervised by a Commission composed
of seven
FIVE members, citizens and residents of this Stater ALL
OF WHOM SHALL HAVE PRACTICAL KNOWLEDGE OF THE
TIDEWATER FISHERIES. The members shall be appointed by the
Governor for terms of seven (7) years and shall reside in and repre-
sent the following areas: two from the Eastern Shore; two from the

Baltimore, Calvert, Charles, Harford and St. Mary's; one from Bal-
timore City; one from Western Maryland, FIVE '(5) YEARS BE-
GINNING ON THE FIRST DAY OF JUNE SUCCEEDING THEIR
APPOINTMENT. THE APPOINTMENTS SHALL BE AS FOL-
LOWS: TWO MEMBERS FROM THE NINE COUNTIES OF THE
EASTERN SHORE, TWO MEMBERS FROM THE TIDEWATER
SECTION OF THE WESTERN SHORE, AND ONE MEMBER
FROM THE STATE AT LARGE. PROVIDED, HOWEVER, OF
THOSE MEMBERS FIRST APPOINTED ONE SHALL SERVE
FOR ONE YEAR, ONE SHALL SERVE FOR TWO YEARS, ONE
SHALL SERVE FOR THREE YEARS, ONE SHALL SERVE FOR
FOUR YEARS, AND ONE SHALL SERVE FOR FIVE YEARS.
which shall consist of the counties of Allegany, Carroll, Frederick,
Garrett, Howard, Montgomery, Prince George's and Washington; and
