transmitting of Justice of the Peace dockets, successor Justices
of the Peace, and relating generally to Justices of the Peace in
Frederick County.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 29 of Article 52 of the Annotated Code of Maryland
(1957 Edition), title "Justices of the Peace", sub-title "Docket",
be and it is hereby repealed and re-enacted, with amendments, to
read as follows:

29. (a) Whenever a justice of the peace shall vacate his office
by resignation, removal from office, or the expiration of his official
term, he shall deliver his docket, together with all the notes, bonds,
accounts and papers in his possession appertaining to judgments or
whereupon suits have been entered, to the clerk of the circuit court
for the county in which such justice resides, or to the clerk of the
Baltimore City Court, in case such justice resides within the City
of Baltimore, within thirty days after such resignation, removal
from office, or expiration of official term; and any justice of the
peace who shall fail to deliver his docket, as aforesaid (in case the
said docket shall not have been unavoidably lost or destroyed), shall
be deemed guilty of a misdemeanor and on conviction thereof shall
be subject to a fine of two hundred dollars or to six months im-
prisonment in the jail of the county or city, at the discretion of the
court.

(b) Provided however that in the City of Frederick the records
of the Justice of the Peace shall be kept by the Clerk of the Justice's
Court and not transmitted as hereinbefore provided. Any successor
Justice of the Peace may hear and decide cases instituted prior to
his succession to office. Provided further that any papers held by
the Clerk in Frederick City for a period of three years or longer
may be destroyed us provided in Sections 177, 178 and 180 of Article
41 of this Code and the Clerks shall be relieved of the responsibility
of delivering transcripts of the same as hereinafter provided.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1959.

CHAPTER 417
(Senate Bill 527)

AN ACT to repeal and re-enact, with amendments, Section 64 (a) of
Article 2B of the Annotated Code of Maryland (1957 Edition),
title "Alcoholic Beverages", sub-title "Procedure for Issue of
Licenses", to permit a refund of alcoholic beverage license fees
where the licensed premises are taken for public use.
