J. MILLARD TAWES, GOVERNOR 25
contest such action and appeal as provided in Section [670] 669 of
this sub-heading.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1959.
Approved February 16, 1959.
CHAPTER 20
(Senate Bill 33)
AN ACT to repeal and re-enact, with amendments, Sections 89, 329
and 333 of Article 93 of the Annotated Code of Maryland (1957
Edition), title "Testamentary Law", sub-titles "Conveyance of
Real Estate" and "Widows and Widowers", changing references
in the testamentary laws from the sum of $2,000.00 to the sum of
$4,000.00 with reference to a surviving spouse being entitled to
take such sum under the laws of distribution, in order that said
sections may be consistent with an amendment made by Chapter
717 of the Acts of 1957 to what is now Section 137 of said
Article 93.
Whereas, in Chapter 717 of the Acts of 1957, which amended
what is now Section 137 of Article 93 in the 1957 Code, there was a
change made in the testamentary laws of distribution in order to
increase from $2,000.00 to $4,000.00 the amount taken by a surviving
husband or widow; and
Whereas, no comparable changes were made in Sections 89, 329
and 333, which still make reference to the sum of $2,000.00 in these
laws of distribution; and
Whereas, officials of the State who are responsible for the admin-
istration of the testamentary laws are construing the Act of 1957 to
have changed this figure from $2,000.00 to $4,000.00 as an amend-
ment by implication in the three sections which were not specifically
amended; and
Whereas, it is desirable to amend these three remaining sections
in order that the reference to $4,000.00 may be uniform throughout
all the sections of the testamentary laws in which there are refer-
ences to it; now, therefore
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 89, 329 and 333 of Article 93 of the Annotated Code
of Maryland (1957 Edition), title "Testamentary Law", sub-titles
"Conveyance of Real Estate" and "Widows and Widowers", be and
they are hereby repealed and re-enacted, with amendments, to read
as follows:
