as in effect on June 1, 1959. The Code shall be deemed and taken in
all the Courts of the State and by all Justices of the Peace and Trial
Magistrates of the State and by all other public officials of the State
and of any political sub-division thereof to be evidence of the Public
Local Laws of Kent County in existence at the time of compilation.

Sec. 2. And be it further enacted, That the Board of County
Commissioners of Kent County be and it is hereby authorized and
directed to make an appropriation to provide for the publication of
said Code; and it further is authorized to provide for the sale and
distribution of said Code.

Sec. 3. And be it further enacted, That this Act shall take effect
June 1, 1959.

CHAPTER 14
(Senate Bill 25)

AN ACT to propose an amendment to Section 11 of Articled of the
Constitution of Maryland, title "Attorney General and State's
Attorneys", sub-title "State's Attorneys", amending the constitu-
tional provisions concerning the filling of vacancies in the office
of State's Attorneys to clarify the language with respect to the
filling of a vacancy in a county not haying a resident judge, and
submitting this amendment to the qualified voters, of the State of
Maryland for their adoption or rejection.

Section 1. Be it enacted by the General Assembly of Maryland,
(Three-fifths of all the members elected to each of the two Houses
concurring), That the following be and it is hereby proposed as an
amendment to Section 11 of Article 5 of the Constitution of Mary-
land, title "Attorney General and State's Attorneys", sub-title
"State's Attorneys", the same, if adopted by the legally qualified
voters of the State, as herein provided, to become Section 11 of
Article 5 of the Constitution of Maryland:

Sec. 11. Vacancy in office of State's Attorney.

In case of a vacancy in the office of State's Attorney, or of his
removal from the county or city in which he shall have been elected,
or on his conviction as herein specified, the said vacancy shall be
filled by the Judge or Judges resident in the county [and] or , IF
THERE BE NO RESIDENT JUDGE, THE JUDGE OR JUDGES
having jurisdiction in the Circuit Court of the county in which the
vacancy occurs, or by the Supreme Bench of Baltimore City for a
vacancy occurring in Baltimore City, for the residue of the term
thus made vacant.
