AN ACT to repeal and re-enact, with amendments, Section 2 of
Article 78B of the Annotated Code of Maryland (1957 Edition),
title "Racing Commission", sub-title "In General", relating to com-
position and membership of Maryland Racing Commission, chair-
man, terms, vacancies, removal and other matters generally related
thereto.

Section 418 thereof and to be under the new sub-heading "Ob-
scene Motion Pictures", making it a crime to exhibit obscene or
corrupting motion pictures to minors and providing a penalty
therefor.
Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 418A be and the same is hereby added to Article
27 of the Annotated Code of Maryland (1957 Edition), title "Crimes
and Punishment", sub-title "Crimes and Punishments", to follow
immediately after Section 418 thereof and to be under the new sub-
heading "Obscene Motion Pictures", and to read as follows:
Obscene Motion Pictures
418A. It shall be unlawful for any person to knowingly exhibit to
a minor under the age of eighteen (18) years, a motion picture
film TO A MINOR UNDER THE AGE OF EIGHTEEN (18)
YEARS WHICH FOR SUCH MINOR WOULD BE:
(a). Which is obscene, or OBSCENE, INDECENT OR IM-
MORAL, OR
(b). The tendency of which is to corrupt morals. OF SUCH
CHARACTER THAT ITS EXHIBITION WOULD TEND TO
DEBASE OR CORRUPT THE MORALS OF SUCH MINOR AS
AFORESAID.
Any person violating this section shall, on conviction thereof
for the first offense, be fined not more than one hundred dollars
($100.00), or imprisoned for not more than thirty days, or both
BE SUBJECT TO A FINE NOT EXCEEDING TWO HUNDRED
DOLLARS OR BE IMPRISONED FOR NOT EXCEEDING ONE
YEAR, OR BOTH fine and imprisonment, at the discretion of the
court.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1959.
