point and the northernmost tip of Drum Point, until a resurvey of
the Wye River, Wye Narrows and East Wye River shall be completed
designating commercially productive oyster areas therein; provided,
however, that after such survey nothing herein contained shall deny
the Commission of Tidewater Fisheries the right to permit soft shell
clam dredging south of the above mentioned line as said survey may
disclose to be proper; or
(f) In the Queen Anne's County waters of East Wye River (also
known as Back Wye) west of a line drawn from the southernmost
tip of Wye Island (also known as Bordley Point) and the northern-
most tip of Bruff's Island, until a resurvey of the Wye River, Wye
Narrows and East Wye River shall be completed designating com-
mercially productive oyster areas therein; provided, however, that
after such survey nothing herein contained shall deny the Commis-
sion of Tidewater Fisheries the right to permit soft shell clam dredg-
ing west of the above mentioned line as said survey may disclose to
be proper.
(g) In Kent Island Narrows and the Chester River entrance there-
to between the shore line and a line drawn from the northernmost
tip of Ferry Point to the northernmost tip of Long Point.
(2) It shall be lawful to take or catch, or attempt to take or catch
soft shell clams as follows:
(a) In all the waters of Queen Anne's County not otherwise specif-
ically prohibited;
(b) In the waters of the Chesapeake Bay bordering upon or ad-
joining Queen Anne's County, without restriction or limitation as
to the area or submerged bottom where soft shell clams may be taken
or caught by the use of mechanical or hydraulic dredge arising from
any designation of oyster bars or natural oyster bars on the charts
of the Commission of Tidewater Fisheries, anything to the contrary
in this section or sub title notwithstanding. ; PROVIDED, HOW-
EVER, THAT NOTHING HEREIN CONTAINED SHALL PER-
MIT THE TAKING OR CATCHING OF SOFT SHELL CLAMS
WITHIN FIFTY (50) YARDS OF ANY COMMERCIALLY PRO-
DUCTIVE OYSTER AREA.
(c) In the Wye River and Wye Narrows north of a line drawn
from the southernmost tip of Ferry Point and the northernmost tip
of Drum Point, without restriction or limitation arising from a
designation of oyster bars or natural oyster bars on the charts of
the Commission of Tidewater Fisheries; provided, however, that
nothing herein contained shall permit the taking or catching of soft
shell clams within fifty (50) yards of any commercially productive
oyster area.
(d) In East Wye River (also known as Back Wye) east and north
of a line drawn from the southernmost tip of Wye Island (known as
Bordley Point) to the northernmost tip of Bruff's Island without
restriction or limitation arising from a designation of oyster bars or
natural oyster bars on the charts of the Commission of Tidewater
Fisheries; provided, however, that nothing herein contained shall
permit the taking or catching of soft shell clams within fifty (50)
yards of any commercially productive oyster area.
