78A. SPECIAL PROCEDURE IN MONTGOMERY COUNTY.

IN MONTGOMERY COUNTY, A FINAL DECISION OF THE
DISTRICT COUNCIL ON ANY APPLICATION FOR A MAP
AMENDMENT MAY, WITHIN 30 DAYS AFTER THE DECISION
IS RENDERED BY RESOLUTION OF THE COUNCIL, OR WITH-
IN 30 DAYS AFTER THE FINAL DECISION OF THE COUNCIL
ON A PETITION FOR RECONSIDERATION, BE APPEALED BY
ANY PERSON AGGRIEVED BY THE DECISION TO THE CIR-
CUIT COURT FOR THE COUNTY, WHICH SHALL HAVE
POWER TO AFFIRM THE DECISION OF THE DISTRICT COUN-
CIL OR, IF SUCH DECISION IS NOT IN ACCORDANCE WITH
THE LAW, TO REVERSE SUCH DECISION, WITH OR WITHOUT
REMANDING THE CASE FOR REHEARING, AS JUSTICE MAY
REQUIRE. WHENEVER ANY SUCH APPEAL IS TAKEN, A
COPY THEREOF SHALL BE SERVED ON THE DISTRICT
COUNCIL BY THE CLERK OF THE COURT, AND THE DIS-
TRICT COUNCIL SHALL PROMPTLY GIVE NOTICE OF THE
APPEAL TO ALL PARTIES TO THE PROCEEDING BEFORE IT
AND SHALL, WITHIN 15 DAYS AFTER THE FILING OF THE
APPEAL, FILE WITH THE COURTS THE ORIGINALS OR CER-
TIFIED COPIES OF ALL PAPERS AND EVIDENCE PRESENTED
TO THE COUNCIL IN THE PROCEEDING BEFORE IT, TO-
GETHER WITH A COPY OF ITS OPINION AND RESOLUTION.
ANY PARTY TO THE PROCEEDING IN THE CIRCUIT COURT
AGGRIEVED BY THE DECISION OF SAID COURT MAY AP-
PEAL FROM SUCH DECISION TO THE COURT OF APPEALS.
THE REVIEW PROCEEDINGS PROVIDED BY THIS SUB-SEC-
TION SHALL BE EXCLUSIVE.

79. Special Procedure in Prince George's County.

(a)  Stenographic record. There IN PRINCE GEORGE'S COUN-
TY THERE shall be a stenographic record made by a duly author-
ized and competent stenographer or reporter of all hearings on
petitions for zoning map amendments as provided herein. The steno-
graphic record made shall not be destroyed until the time for appeal
or rehearing on any petition for zoning map amendments has expired.

(b)  Filing fees; transcript.The person, corporation, or party
making application for a zoning map amendment at the time of
paying the advertising costs shall pay an additional filing fee of
five dollars ($5.00). Any person, corporation, or party noting an
appeal from the decision of the District Council, or who or which
for any reason shall request a transcript to be transcribed as here-
in provided, shall pay to the County Commissioners of Prince
George's County the cost or estimated costs of transcribing the
stenographic record.

(c)  Notice to near-by property owners.Each District Council is
empowered to include in its regulations provisions for additional no-
tice of the public hearing on any proposal for amendment of its zoning
plan or regulations, to be given to the owners (as they appear on
the assessment rolls of the County) of properties adjoining or
across the road from, or in the same block as, or in the general
vicinity of, the properties involved in the proposed amendment.
Such notice may be given by mail or by posting of the notice on or
in the vicinity of the properties involved in the proposal or both.
