Whereas, At the present time the location of the boundary line
between Montgomery and Prince George's Counties remains unde-
termined, causing considerable inconvenience and difficulty to certain
residents of both counties and to the counties themselves, and
Whereas, It would be in the interest of Montgomery and Prince
George's counties and the citizens thereof to ascertain the definite
location of the said boundary line; now, therefore
Section 1. Be it enacted by the General Assembly of Maryland,
That the County Council of Montgomery County and the County
Commissioners of Prince George's County be and they are hereby
directed to procure the services of the County surveyors or other
qualified registered surveyors of their respective counties to work
together, using all the records which can be discovered pertaining to
the said line, to survey and definitely locate on the ground to the best
of their ability the boundary line between Montgomery and Prince
George's Counties.
Sec. 2. And be it further enacted, That said surveyors, as soon as
they have surveyed and established the division line, as aforesaid,
shall permanently mark said line on the ground at its terminal points,
and along said line by planting thereon, and along the same, suitable
permanent monuments properly marked so as to designate said divi-
sion line so placed as to be not more than one-half mile apart along
the whole of said line.
Sec. 3. And be it further enacted, That said surveyors shall be
directed to make a report which shall be submitted to the next 90-day
session of the General Assembly giving explanation of the establish-
ment of the said boundary line, along with a plat showing the said
line as established, for the purpose of affording to the General As-
sembly the opportunity to confirm the line as established and make
it conclusive evidence of the true boundary line between the counties.
Sec. 4. And be it further enacted, That the County Council of Mont-
gomery County and the County Commissioners of Prince George's
County are hereby authorized to appropriate such sums of money as
necessary, respectively, in order to carry out the directions of this
Act. The cost of said survey and report shall be borne equally by
the said counties.
Sec. 5. And be it further enacted, That nothing herein shall be
construed or applied so as to require any resident of either Mont-
gomery or Prince George's County to make a second payment or a
re-payment of any taxes paid on real or personal property to either
of such counties, by reason of the establishment of a definitive bound-
ary between the two counties as in this Act provided, it being the
legislative intent that there shall be no claim for a second payment
or for a re-payment of any taxes paid in good faith to one of the
two counties.
Sec. 6. And be it further enacted, That this Act shall take effect
June 1, 1959.
