CHAPTER 55
(House Bill 123)

AN ACT to repeal and re-enact, with amendments, Sections 112 and
151 of Article 66C of the Annotated Code of Maryland (1957
Edition and 1959 Supplement), title "Natural Resources", sub-
title "Birds, Game and Inland Water Fish", sub-headings "Title
and Definitions", and "Waterfowl and Migratory Birds", to define
what constitutes a duck blind and to change certain methods of
hunting wild waterfowl in the State.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That Sections 112 and 151 of Article 66C of the Annotated Code of
Maryland (1957 Edition and 1959 Supplement), title "Natural Re-
sources", sub-title "Birds, Game and Inland Water Fish", sub-
headings "Title and Definitions", and "Waterfowl and Migratory
Birds", be and they are hereby repealed and re-enacted, with amend-
ments, to read as follows:

112. Definitions,

(a) Whenever used in this subtitle, unless a contrary intention
is evident from the context, the word "person" shall include indi-
viduals, copartnerships, associations, and corporations; the singular
shall include the plural, and the masculine, the feminine and neuter.

(b) The term "game birds" shall include: (a) The anatidae, com-
monly known as swan, geese, brant, river and sea ducks; (b) the
pygopodes, commonly known as loons and grebes (the members of
these two orders being commonly known as wild waterfowl); (c)
the rallidae, commonly known as rails or sora, coots, mudhens, and
gallinules; (d) the limicolae, commonly known as shore birds, plover,
surf birds, snipe, woodcock, sandpipers, tattlers, and curlew; (e) the
gallinae, commonly known as wild turkey, ruffed grouse, pheasants,
doves, partridges and quail; (f) the birds commonly known as
reedbirds and blackbirds.

(c) The term "game animals" shall include: (a) The deer; (b)
the bear; (c) the wild rabbit and hare; (d) the red, gray, black, and
fox squirrel; (e) the raccoon; and (f) the opossum.

(d) The term "game" shall include "game animals" and "game
birds", which are protected by law.

(e) The term "fur-bearing animal" shall include: (a) The mink;
(b) the muskrat; (c) the otter; (d) the beaver.

(f) The term "vermin" shall include all wild animals not classed
as game animals or fur-bearing animals, and all wild birds other
than game birds and protected birds.

(g) The term "unprotected birds" shall include: (a) The English
sparrow; (b) the European starling; (c) the buzzard; (d) the crow.

(h) The term "protected birds" shall include all wild birds not
included within the terms "game birds" and "unprotected birds".
