CHAPTER 491
(Senate Bill 534)

AN ACT to repeal and re-enact, with amendments, Section 8 of
Article 25 of the Annotated Code of Maryland (1951 Edition),
title "County Commissioners", sub-title "General Provisions",
amending the provisions concerning the power and authority of
the County Commissioners of the several counties and of the Coun-
ty Council of Baltimore County to pay certain supplemental retire-
ment benefits to public school teachers who have retired. , AND
SPECIFYING THE EFFECT OF THIS ACT UPON SECTION
304 OF THE CODE OF PUBLIC LOCAL LAWS OF BALTI-
MORE COUNTY (1955 EDITION).

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 8 of Article 25 of the Annotated Code of Maryland
(1951 Edition), title "County Commissioners", sub-title "General
Provisions", be and it is hereby repealed and re-enacted, with amend-
ments, to read as follows :

8. (a) The County Commissioners or County Council of the
several counties shall have the power and authority, in their dis-
cretion, to pay to any school teacher of their county who is retired
and who is receiving any retirement benefits under the provisions of
other laws, where such benefits in the aggregate are less than
[$100.00] $125.00 per month, an additional sum not exceeding
[$25.00] $50.00 per month upon application to the County Com-
missioners or County Council, and said Commissioners or Council
shall annually levy an amount sufficient to pay such additional bene-
fits. Provided that the sum granted to any applicant by the said
County Commissioners or Council shall be such that when added to
whatever any such person is receiving as retirement pay under other
laws, the total shall not exceed One Hundred and twenty-five Dollars
per month.

(b) The County [Commissioners] Council of Baltimore County
are authorized and empowered to pay such additional benefits for
period, or any part of such period, to any applicant who for any part
or all of said period was a school teacher of said county who was
retired and who was receiving any retirement benefits under the
provisions of other laws, where such benefits in the aggregate were
less than One Hundred and twenty-five Dollars per month. The
amount of any such payment or payments shall be as specified herein-
above in this section. NOTHING IN THIS SECTION SHALL BE
CONSTRUED OR APPLIED TO CHANGE OR AMEND IN ANY
MANNER THE PROVISIONS OF SECTION 304 OF THE CODE
OF PUBLIC LOCAL LAWS OF BALTIMORE COUNTY (1955
EDITION).

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1957.
