make application for such assistance, but the assistance, if granted,
shall not begin until after he ceases to be an inmate. In the event
that future Federal legislation should make possible the grant of
assistance to inmates of public institutions, the limitations set forth
in this sub-section may be rendered null and void by rule and regu-
lation of the State Department, if it is found desirable to conform
thereto.
(d) Is not receiving old age assistance.
(e) [has not made an assignment or transfer of property for the
purpose of rendering himself eligible for assistance under this
Article at any time within three (3) years immediately prior to the
filing of application for public assistance or the receipt of assistance
pursuant to the provisions of this sub-title.]
(F) Does not (publicly solicit alms in any part of this State; the
term "publicly solicit" shall be construed to mean either wearing, car-
rying or exhibiting signs denoting blindness for the securing of alms
or carrying receptacles for the purpose of securing alms or doing
same by proxy; the term also shall include stationary or house-to-
house begging or any other means of publicly seeking alms.
15A. No applicant or recipient shall be denied the aid provided
for in this sub-title because he is attending, or plans to attend, any
public high school in this State or any university or college or other
institution of higher learning or any trade or professional school.
16. (Amount of Assistance.) [The amount of public assistance
to the needy blind which any recipient shall receive shall be deter-
mined by the County Board with due regard to the available re-
sources and necessary expenditures of the individual and the condi-
tions existing in each case, and shall be sufficient, when added to
all other income and support available to the recipient, to provide
such person with a reasonable subsistence compatible with decency
and health. In determining the eligibility of any applicant for aid
under the provisions of this sub-title the first Fifty Dollars ($50)
of earned income per month shall be disregarded and shall not be
deemed an available resource of the applicant within the meaning
of this sub-title.]
(a) The individual needs of each person claiming aid to the blind
shall be presumed and deemed to be not less than Seventy-five Dol-
lars ($75) per month. The amount of aid to which any claimant may
be entitled shall be, when added to the income (including the value
of currently used resources but excepting casual income and incon-
sequential resources) of the claimant from all other sources, Seventy
five Dollars ($75) per month. if, however, in any case, it is found
the actual need of a claimant exceeds Seventy five Dollars ($75) per
month, such claimant shall be entitled to receive aid in an amount
which shall meet such actual need, unless the amount of aid he is
otherwise entitled to receive when added to the income (including
the value of currently used resources, but excepting casual income
and inconsequential resources) from all other sources, shall equal
his actual need. The aid granted under this sub-title shall be paid
monthly, in advance.
