however, that any party upon whom said assessment may be levied
under this sub-section may protest or appeal said assessment, in
the same manner under the law of the said county, or city, town,
village or special taxing area levying such assessment, as may any
other party otherwise entitled to protest or appeal under said law,
provided however that the city, town, village or special taxing area
may in its discretion pay all or part of the costs so assessed by the
County against the properties within its jurisdiction.
(c) Nothing in this section shall be construed to affect state roads,
except to the extent that Montgomery County participates in pay-
ment of the cost of construction pursuant to agreement with the State
Roads Commission.
SEC. 2. And be it further enacted, That this Act shall take effect
June 1, 1957.

(Senate Bill 396)
AN ACT to repeal and re-enact, with amendments, Section 22 of
Article 66B of the Annotated Code of Maryland (1951 Edition),
title "Zoning and Planning", sub-title "Title 2—Zoning", relating
to the decision and order made by the Circuit Court of any county
in certain cases involving zoning matters and providing that an
appeal may be taken therefrom to the Court of Appeals of Mary-
land.
Section 1. Be it encoded by the General Assembly of Maryland,
That Section 22 of Article 66B of the Annotated Code of Maryland
(1951 Edition), title "Zoning and Planning", sub-title "Title 2—
Zoning", foe and it is hereby repealed and re-enacted, with amend-
ments, to read as follows:
22. (Board of Appeals.) (a) The council shall provide for the
appointment of a Board of Appeals, and in the regulations and
restrictions adopted pursuant to the authority of this sub-title may
provide that the said Board of Appeals may, in cases where it is
exceptionally difficult if not impossible to comply with the exact
provisions of the ordinance, make such variation as. will prevent
unwarranted hardship or injustice and at the same time most nearly
accomplish the purpose and intent of the regulations of the zoning
plan.
(b) The Board of Appeals shall consist of three members. The
term of office of the members of the board shall foe three years. They
shall foe appointed by the mayor, confirmed by the council, and re-
movable for cause, upon written charges, and after public hearing.
