to be known as Sections 187-196, inclusive, and to follow immedi-
ately after Section 186 of said Article, and to be under the new
sub-title "Potato Seed Inspections" relating to standards for
potatoes for propagation purposes, requiring potatoes for such
purposes to meet the standards, and providing penalties for
violations.
Section 1. Be it enacted by the General Assembly of Maryland,
That ten new sections be and they are hereby added to Article 48 of
the Annotated Code of Maryland (1951 Edition), title "Inspections",
said new sections to be known as Sections 187-196, inclusive, to follow
immediately after Section 186 of said Article and to be under the new
sub-title "Potato Seed Inspections", and to read as follows:
POTATO SEED INSPECTIONS
187. (Definitions and Standards)
(a) "Certified" Irish potatoes and parts thereof for propagation
uses shall mean Irish potatoes and parts thereof which conform to the
standards fixed by the International Crop Improvement Association
in classifying and determining what shall constitute "certified"
potatoes for propagation purposes and in conformity with the regula-
tions established by the state in which the potatoes were grown.
(b) "U. S. No. 1" Irish potatoes, when the same are intended to
be used for propagation purposes shall mean Irish potatoes which
conform to the standards issued by the United States Department of
Agriculture for "U. S: No. 1" potatoes when the same are intended to
be used for propagation purposes.
188. (Sale) It shall be unlawful for any person, firm, corporation,
partnership or other association to pack for sale, offer or expose for
sale, or ship into this State for such purposes, or sell (all of which
terms are hereinafter covered by the word sell or sale), any Irish
potatoes or parts thereof intended for propagation purposes, which
do not conform to the standards of certified and U. S. No. 1 potatoes
as provided in this sub-title.
189. (Enforcement) The State Board of Agriculture of Maryland
through its duly authorized agents and qualified inspectors is hereby
authorized, directed and empowered to enforce the provisions of this
sub-title and shall have the power to define, promulgate and enforce
such reasonable rules and regulations as may be deemed necessary
therefor and as may be not inconsistent therewith, including the
payment of reasonable fees, as may be necessary to effectuate the
purposes of this sub-title.
190. (Powers) In order to carry out the provisions of this sub-
title, the State Board of Agriculture through its duly appointed en-
forcing officers is authorized to enter any place of business, ware-
house, common carrier or other place where potatoes for propagation
purposes are stored or being held, and to inspect any or all of such
potatoes found in such places, warehouse or common carrier, and to
take for inspection such representative samples of the potatoes as
may be necessary to determine whether or not this sub-title has been
violated; and, in addition, when potatoes or parts thereof are found
to be in violation of this sub-title or any rule or regulation adopted
