(3) To prescribe, after public hearing following due public notice,
establish, add to or subtract therefrom by regulations a prohibited
and restricted noxious weed list.
(4) To prescribe after public hearing following due public notice
and to adopt rules and regulations establishing reasonable standards
of germination for vegetable seeds.
(b) Further, for the purpose of carrying out the provisions of this
sub-title, the State Board of Agriculture through its authorized
agents is directed—
(1) To enter upon any public or private premises during regular
business hours in order to have access to seeds subject to this sub-
title and the rules and regulations thereunder.
(2) To issue and enforce a written or printed "stop sale" order
to the owner or custodian of any lot of seed which the authorized
agent of the State Board of Agriculture finds is in violation of any
of the provisions of this sub-title which shall prohibit further sale of
such seed until such authorized agent has evidence that the seed is in
compliance with the law. The provisions of this paragraph shall not
be construed as limiting the right of the authorized agent of the State
Board of Agriculture to proceed as authorized by other sections of
this sub-title.
(3) To establish and maintain or make provisions for laboratory
and field testing of seeds, to employ qualified persons, and to incur
such expenses as may be necessary to comply with these provisions.
(4) To make or provide for making purity analyses, germination
tests, and examinations of seeds for farmers and dealers on request;
to prescribe rules and regulations governing such analyses, tests,
and examinations; and to fix and collect charges for the analyses,
tests, and examinations made.
(5) To publish the results of the analyses, tests, and examinations
made under the provisions of this sub-title, together with any other
information deemed advisable.
(6) To cooperate with the United States Department of Agricul-
ture in seed law enforcement.
(7) To direct seed certification work in the State.
(c) To provide, when deemed urgent and necessary for the prompt
performance of the duties specified in this section, and the State
Board of Agriculture is not then in session, the order may be estab-
lished, maintained and enforced by the following officials of the Uni-
versity of Maryland, or a majority of them: (1) the Chairman of the
State Board of Agriculture or any other member of the Board he may
designate sitting as the State Board of Agriculture; (2) the Execu-
tive Officer of the State Board of Agriculture, who is the President of
the University; (3) the Dean of Agriculture; (4) the Head of the
Agronomy Department; (5) the person in charge of the Seed Labora-
tory, and such action by these officials, or a majority of them, shall
be fully effective and applicable in all respects as the action of the
State Board of Agriculture. The Board shall be notified of any such
order at its next meeting thereafter and the order shall continue in
full effect and applicability until and unless modified or abrogated
by the said officials, or a majority of them, or by the State Board of
Agriculture.
