any suggestions or objections as to any particular bundle to be in-
cluded or excluded from the sample or to interfere or to try to use
any influence in regard to same; and any person violating this pro-
vision shall, upon conviction, be subject to the penalty prescribed by
Section 56 of this Article.
23. No claims for damages against the warehouses for unsound
or damaged tobacco shall be allowed or paid except for damages
caused by fire or water, IF for which insurance coverage is[ available
AND CARRIED as hereinafter provided.
26. In all sales of leaf tobacco, where the same may be packed
in hogsheads or casks and no price is specifically agreed upon be-
tween the seller and buyer, the buyer shall be deemed to have agreed
to pay for said hogshead or cask in which said tobacco may be packed,
the sum of [Three ($3.00) Dollars] Six Dollars ($6.00) or the pre-
vailing price for hogheads or casks if the same be more than Six
Dollars, and the seller shall have the right, in the absence of an
express agreement to the contrary, to demand the said sum [of Three
($3.00) Dollars] for said hogshead or cask to be added to the pur-
chase price of said tobacco.
32. All tobacco [thus] stayed shall, with all convenient dispatch
be shaken out, reconditioned and packed under the supervision of
the inspector and reweighed and entered upon the inspection books
as all other tobacco.
36. Whenever tobacco shall be delivered at any of the warehouses
in the City of Baltimore for inspection, in such condition as to re-
quire cooperage, the Inspector may refuse to accept such tobacco or
may accept such tobacco and may charge a reasonable sum to repair
or recooper the tobacco.
43. Every hogshead of tobacco inspected in the Maryland State
Tobacco Warehouse which shall remain in such warehouse, after
having been sold by the grower or his agent, for a period longer than
six months from date of sale thereof, shall be subject to such storage
charges, after the expiration of such period of six months from date
of sale, as shall, from time to time, be fixed by the inspector. All
tobacco thus stored shall be subject to a thirty day notice by the In-
spector for immediate removal.
4,8. It shall be lawful for the Inspector of Tobacco to receive from
any grower or owner of tobacco grown in this State such tobacco
for storage-only when he has determined that space is, or is reason-
ably anticipated will be, available in the warehouses for storage-only
tobacco, preference shall be given to the requests of growers and next
in equal status to other owners requesting such storage. All such
tobacco received shall be subject to whatever charges that are cur-
rently in force and shall be subject to a thirty day notice by the In-
spector for immediate removal and to all other applicable laws and
regulations. Tobacco stored in the warehouses under the provisions
of this section shall not be inspected by the Inspector or by any
private inspector unless such inspection is requested by the owner
who shall thereupon pay the appropriate charges therefor.
