AN ACT to repeal and re-enact, with amendments, Section 526 of the
Charter and Public Local Laws of Baltimore City (1949 Edition),
being Article 4 of the Code of Public Local Laws of Maryland,
title "Baltimore City", sub-title "Police Commissioner", sub-head-
ing "Organization of Force", providing for an increase in the
salary of the Police Commissioner of Baltimore City, and provid-
ing that this increase shall not apply to the present Police
Commissioner.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 526 of the Charter and Public Local Laws of Balti-
more City (1949 Edition), being Article 4 of the Code of Public
Local Laws of Maryland, title "Baltimore City", sub-title "Police
Commissioner", sub-heading "Organization of Force", be and it is
hereby repealed and re-enacted, with amendments, and to read as
follows:
526. There shall be appointed by the Governor on June 1, 1949,
and every six years thereafter, one discreet person, resident or
engaged in business in the City of Baltimore for three consecutive
years next preceding the day of his appointment, who shall be known
as the Police Commissioner for the City of Baltimore, and whose
term of office shall continue for six years and until his successor is
appointed and qualified. If a person appointed Police Commissioner
is a member of a Retirement or Pension System of the State of
Maryland or City of Baltimore, he shall have the right to continue
as a member of such system, with all the rights, privileges and
benefits which the members of such system may have as to retire-
ment on pension or the payment of pension or other benefits to his
widow or other beneficiary, provided he continues to pay the same
rate of contribution to such retirement system or pension fund which
he was paying when he became Police Commissioner.
Upon ceasing to be Police Commissioner, such person shall have
the right to be retired on pension, with all the rights and privileges
of the system of which he is a member, without any regard to the
age requirements or the requirements for physical examination
required by such system, provided the total combined service prior
to becoming Police Commissioner and as Police Commissioner
shall be not less than twenty-five (25) years. He shall be subject to
removal by the Governor for official misconduct or incompetency in
the manner provided by law in the case of civil officers; he shall
receive a salary of [Ten Thousand Dollars ($10,000.00) ] Fifteen
Thousand Dollars ($15,000.00) EIGHTEEN THOUSAND DOL-
LARS ($18,000.00) per annum, payable quarterly [, until Decem-
ber 31, 1949, and thereafter he shall receive a salary of Twelve
Thousand Five Hundred Dollars ($12,500.00) per annum, payable
quarterly]. The said Commissioner shall not be eligible to an elective
or appointed office during the term for which he was appointed.
