VOTING MACHINES
119. Use of Voting Machines Authorized. (a) General Provisions.
The Boards of Supervisors of Elections of Baltimore City and of the
respective counties shall provide for the use of voting machines in
all elections, general, primary and special, in accordance with the
provisions of this Article and under such rules and regulations as said
Boards may deem advisable or necessary. The said Boards may pur-
chase, rent, lease or otherwise acquire such number of voting machines
as may be required to equip any and all of the polling places in said
city or county, as the case may be. In the event of the leasing,
rental or other acquisition of such machines, they shall be exempt
from State, county or municipal taxation.
(b) Laws Applicable. The conduct of all elections, general,
primary or special, shall be as hereafter provided in this sub-title,
instead of as provided in Sections 105 to 111, inclusive, except as
specifically therein stated.
(c) Number of Voting Machines. At least one voting machine shall
be furnished for each unit of five hundred voters, and an additional
machine for every fractional part of such unit; in the case of special
elections, however, the Supervisors of Elections in any county in
their discretion may determine the number of machines to be
furnished to each polling place.
(d) Judges. In polling places where voting machines are used, the
elections shall be conducted by the four judges of election and no
clerks of election shall be appointed.
(e) Paper Ballots Authorized. Where the Supervisors do not have
available or are unable to procure voting machines, paper ballots may
be used, in which case the election shall be conducted in all respects
as provided in this Article for elections held by paper ballots,
including the appointment of clerks of election. Also, in the event
that the number of names or the number of questions submitted
for vote at any election is too large for the practical use of voting
machines, the said Boards of Supervisors shall supply paper ballots
in the usual form for use in voting.
(f) Acquisition of Voting Machines. The Boards of Supervisors
of Elections and the County Commissioners or County Councils in
the several political sub-divisions shall use the powers conferred upon
them for the acquisition of voting machines, and shall acquire or
have available the necessary number of voting machines for use at
all elections. ; THE COUNTY COMMISSIONERS OR COUNTY
COUNCILS SHALL PROVIDE FOR THE PAYMENT FOR SUCH
MACHINES.
120. Borrowing Power for Voting Machines. (a) Counties Author-
ized to Borrow. Whenever the Board of Supervisors of Elections of
any county shall determine to purchase voting machines, the Board
of County Commissioners or County Council thereof is hereby au-
thorized and empowered to borrow, from time to time, in such
amounts as it shall deem necessary without regard to any limitations
upon its borrowing power, money on the faith and credit of such
county and to issue bonds for the purpose of providing funds to pay
the cost of such voting machines.
