SEC. 2. And be it further enacted, That this Act shall take effect
June 1st, 1958.

CHAPTER 12
(House Bill 5)
AN ACT to repeal Chapter 30 of the Acts of the General Assembly
of 1958, relating to the right of the Board of County Commission-
ers of St. Mary's County to borrow a certain sum of money and
relating also to the amount and to the time, manner, procedure,
rate of interest and re-payment of any such borrowed monies and
the use of the proceeds thereof; and to re-enact, without change,
the provisions of said Chapter 30 in order to resolve any possible
doubts about its unconstitutionality.
WHEREAS, By Chapter 30 of the Acts of the General Assembly of
1958 the Board of County Commissioners of St. Mary's County was
authorized to borrow a certain sum of money; and
WHEREAS, A possible question has been raised concerning the
constitutionality of this Act since it received action by the General
Assembly following the thirtieth calendar day of the 1958 Session
and also because it might be construed to be a "local" bill; and
WHEREAS, It is deemed desirable to resolve any such questions of
invalidity by re-enacting said Chapter 30 without change; now,
therefore
SECTION 1. Be it enacted by the General Assembly of Maryland,,
That Chapter 30 of the Acts of the General Assembly of 1958, be
and it is hereby repealed.
SEC. 2. And be it further enacted,, That the Board of County Com-
missioners of St. Mary's County is authorized and empowered to
borrow up to but not exceeding the sum of $140,000 in order to
defray necessary and proper expenses for the operation of the
County government during the period between the effective date of
this Act and June 30, 1958, inclusive. Any amount so borrowed shall
be evidenced by notes, bonds or other certificates of indebtedness
issued upon the faith and credit of St. Mary's County. The time,
manner, procedure, rate of interest and repayment of any such bonds,
notes or other certificates of indebtedness shall be as determined by
resolution of the Board of County Commissioners of St. Mary's
County.
SEC. 3. And be it further enacted, That this Act is hereby declared
