CHAP. CXVI.
An Act respecting the Herding of Cattle in Allegany County.
Whereas it hath been represented to this general assembly, that
clivers persons, not citizens of this state, are in the habit of bring-
ing large numbers of cattle, horses and hogs, into the upper part
of Allegany county, and there leaving them to graze and pasture
during the summer season; therefore,
1. Be it enacted, by the General Assembly of Maryland, That from
and after the passage of this act, if any person or persons, not re-
sidents or citizens of this state, shall drive, or cause to be driven
into the upper part of Allegany county, any black cattle, horses or
hogs, and leave there for the purpose of grazing or pasturing, it
shall be the duty of such person or persons, to place the said black
cattle, horses or hogs, in the care, and under the superintendance
and management of a herdsman or herdsmen, legally licensed as
hereinafter directed; and it shall be the duty of the owner or own-
ers of any such black cattle, horses or hogs, to pay to such herds-
man or herdsmen, upon the delivery of such stock to his or their
care, the tax herein after imposed, to be accounted for by said
herdsman or herdsmen as herein after directed.
2. And be it enacted, That before any person or persons shall act
or undertake to become a herdsman, he or they shall apply to some
justice of the peace of said county, for a license as such, during the
term of one year, which license shall be renewed annually, and the
said herdsman or herdsmen so licensed, shall annually at each and
every sitting of the levy court of said county, when convened for
the purpose of laying the county tax, account with and pay to the
said levy court the sum of twenty-five cents for each and every
head of black cattle and horses, and the sum of twelve and a half
cents for each and every hog, belonging to citizens of other states,
so herded by him or thorn, and make a statement thereof to said levy
court, upon oath, of the number of black cattle, horses or hogs, so
herded by him or them, and for whom herded; Provided neverthe-
less, that nothing in this act shall be construed to subject the cattle
of citizens of other states, who own lands in said county, to the
tax imposed by this act.
3. And be it enacted, That it shall be the duty of each and every
herdsman or herdsmen, licensed under this act, to give bond and
security to the state of Maryland, in the penalty of four hundred
dollars, conditioned for the payment of the tax herein before im-
posed, to the levy court of said county, at their annual meetings
aforesaid, which bond the justice of the peace granting said license
is hereby required to take and judge of the sufficiency of the secu-
rity to said bond, and lodge the same with the clerk of said county
court, and to be by him kept, and on the payment of the tax by
said herdsman or herdsmen to the said levy court, as herein before
directed, the said bund or bonds to be delivered up to the obligor or
obligors.
