and the other half of the said fees shall be collected and paid over
to the district attorney of Baltimore city court, on account of whose
incapacity the said assistant district attorney shall have been ap-
pointed.
2. And be it enacted, That owing to the inability, from severe in-
disposition of the attorney general, to discharge the duties of his
office, it shall be the duty of the governor to nominate, and by and
with the advice and consent of the council to appoint and commis-
sion, a person of sound legal knowledge to act as assistant attorney
genual during the continuance of such inability, and such assistant
attorney general shall take the several oaths directed to be taken by
the attorney general, and shall perform the several duties required
by law to be performed by the attorney general, and be entitled to
the fees and compensation allowed by law for such services.
3. And be it enacted, That in case of the death, resignation, or
removal out of the state, as the case may be, of the attorney gene-
ral, or district attorney, any commission which may have issued,
either to an assistant attorney general or assistant district attor-
ney, as the case may be, shall cease and determine.
4. And be it enacted, That so much of the act to which this is a
further supplement, and also of the supplement to said art, as is in-
consistent with this act, be and the same is hereby repealed.

CHAP. XXXVIII.

An Act for the benefit of the Infant Legatees of Jacob Franklin.
Whereas it appears to this general assembly, that by reason of
the infancy of the children of James Deale, of the city of Balti-
more, the estate of Jacob Franklin, late of Anne-Arundel county,
deceased, cannot be divided and distributed according to the direc-
tions of the will of the said Jacob Franklin, therefore,
1. Be it enacted, by the General Assembly of Maryland, That James
Deale of the city of Baltimore, as guardian to and in behalf of his
infant children, be and he is hereby authorised and empowered, to
execute such deed or deeds, and covenants, as may be necessary to
convey all the right, title and interest, which the said infant chil-
dren have in or to the. real estate of Ferdinando Battee, late of Anne-
Arundel county, deceased, and that such deed or deeds and coven-
ants, when executed, acknowledged and recorded, according to law,
be as valid and effectual, to all intents and purposes, as if executed
by the children of the said James Deale after their arrival at full age.

CHAP. XXXIX.

An Act for the Relief of Jonathan Rasin, of Kent County.
Be it enacted, by the General Assembly of Maryland, That it shall
not be necessary for Jonathan Rasin, upon application for the be-
nefit of the insolvent laws of this state, to shew a residence of two
years next before his application.

CHAP. XI,.

A Supplement to the Act, entitled, An act to incorporate a Company to make a
Turnpike Road from Edward H. Calvert's Old Mill, in Prince George's Coun-
ty, to the District of Columbia.

Be it enacted, by the General Assembly of Maryland, That the said
company shall have full power and authority to commence the work
authorised to be done by the act to which this act is a supplement,
