payment of the passage money due by such emigrant, or said re-
gister may appraise the same, and the master or owners of the
vessel may take such property at the appraised value in part pay-
ment or satisfaction of the claim for passage money; Provided al-
ways, that if the passenger died before the expiration of one half
of the duration of the voyage, no passage money shall be due, but
the. heirs of the deceased shall be entitled to the proceeds, and the
register shall be accountable for them to such heirs.
11. And be it enacted, That said register shall be entitled for
writing the deed of indenture, and registering the matters above
mentioned, to the same fees as a notary public, and for the sale
or appraisement of property in manner aforesaid, he shall be entit-
led to five per cent commission on the gross amount; and if the
proceeds arising from the sale as aforesaid should remain in hand
uncalled for during three years, after publication in two newspa-
pers, one of which shall be in Baltimore, which publication shall
be made immediately after the sale, in such case the proceeds,
without interest, shall be paid over by the register to the treasurer
of the German Society of Maryland, for the use of said society.

CHAPTER 227.
An act for the better protection of Slave-holders in the seve-
ral Counties therein mentioned.
Sec. 1. Be it enacted by the General Assembly of Maryland, That
from and after the first day of May next, it shall not be lawful for
any licensed retailer or retailers in Culvert county, Anne-Arundel
county, and Saint-Mary's county, or for any person or persons re-
siding in either of those counties, accustomed to make and sell dis-
tilled spirits, or other liquors, to suffer any free negro or mulatto,
or any negro or mulatto servant or slave, to be in his, her, or their
store-house, or other house wherein he, she or they may be accus-
tomed to sell distilled spirits, or other liquors, between sun-set in
the evening, and sun-rise of the succeeding morning; Provided
always, that nothing herein contained shall be construed to extend
to the case of such aforesaid servant or slave, as shall have a writ-
ten order or license for that purpose, from his master, mistress,
overseer, or other person in whose employment he may actually be
with the consent of his owner or owners.
2. And be it enacted, That if any person or persons shall suffer
or permit any negro or mulatto to be in his, her, or their house,
contrary to the provisions of this law, the person or persons so
offending, shall forfeit and pay for every such offence, the sum of
fifty dollars, the one half to the. informer, and the other half to the
said county, in case such negro or mulatto was free, and the one
half to the informer, and the other half to the master, mistress or
owner, in case such negro or mulatto was a servant or slave at the
time the offence was committed, to be adjudged and recovered, on
indictment and conviction, or confession of the party accused, in
the county court of the said counties.
3. And be it enacted, That if on the conviction aforesaid, the per-
son or persons so convicted, shall fail or be unable to pay the fine
aforesaid, (he county court shall, in their discretion, order the said
person or persons so convicted, to be confined in the public gaol in
the county, for a term not exceeding three months.
