said monument, in the manner and agreeable to the plan adopted for
the same; Provided however, that before they proceed to the
sale of tickets in such lottery or lotteries) they give bond to the
state of Maryland in double the sum to be raised thereby, con-
ditioned for the payment of all prizes drawn therein, if demand-
ed within one year after the completion of the lottery, and if
not, such prizes shall be deemed relinquished to the purposes of
the lottery; and further conditioned, that the money so to be
raised shall be applied within two years after such lottery is
drawn, to the finishing and completing of said monument.

CHAPTER 78.

An act for the benefit of the University of Maryland.

Sec. 1. Be it enacted by the General Assembly of Maryland,
That from and after the passage of this law, it shall and may be
lawful to and for John B. Davidge, William Gibson, Nathaniel
Totter, Maxwell M'Dowell, Samuel Baker, Elisha De Butts,
Hugh W. Evans, John Sutherland, James L. Hawkins, Jeremiah
Sullivan, George H. Steuart, Nathaniel Williams and James W.
M'Cullough, of the city of Baltimore, or any five of them, to
propose as managers a scheme or schemes of a lottery or lotteries,
to raise the sum of one hundred thousand dollars, over and
above all expenses of drawing or otherwise attending the same,
and to sell the said tickets in this state, and draw the said lotte-
ry or lotteries in one or more classes in the city of Baltimore,
at such time and in such manner as they may deem best.

2. And be it enacted, That the said managers shall pay over to
the regents of said university the proceeds of said lottery or lotte-
ries, as they arise, who shall, in the first instance, apply such sum
as may be necessary to purchase a complete chemical apparatus,
under the direction of the professor of chemistry in the said uni-
versity, for the time being; and said regents shall apply such
further sum as in addition thereto will make fifty thousand dol-
lars, towards purchasing and procuring apparatus of natural
philosophy, mathematics, mineralogy and botany, and anatomi-
cal preparations; and the residue of the proceeds of said lottery
or lotteries, shall be applied by said regents for the purpose of
extinguishing the debts of said institution, for the erection of ad-
ditional buildings, and for finishing those already erected.

3. And be it enacted, That before said managers proceed to
sell any tickets, they shall give bond to the state of Maryland, in
the penalty of two hundred thousand dollars, conditioned for
their faithful payment of prizes to be drawn agreeably to the
terms and conditions of said lottery or lotteries, provided such
prizes are demanded within one year after the completion of said
lottery or lotteries, and if not, such prizes shall be considered
as relinquished for the benefit of the institution, and generally for
the faithful performance of the trust reposed in them by this
law; which bond shall be filed in Baltimore county court, and
may be sued upon by and for the use of any person or persons
who may be aggrieved in the premises.
