of the said levy court, to supply every such vacancy so happen-
ing by the appointment of another suitable person to act as su-
pervisor, under the same penalties and regulations as if he had
been appointed by a majority of the said justices, and the said
justices shall certify every such appointment, under their hands,
to the clerk of said county, within ten days thereafter; and the
said clerk shall within ten days after being so notified thereof,
issue a warrant to the person so appointed, and deliver the same
to the sheriff of the county aforesaid, to be by him delivered to
the person so appointed, or left at his place of residence, within
ten days after receiving the same, under the penalty of ten dol-
lars current money for every neglect by the sheriff or clerk re-
spectively.
5. And he it enacted, That the levy court of Caroline county
shall, at their first levy in the year eighteen hundred and eighteen,
and at their annual levy in every year thereafter, levy and assess
on the assessable property in said county, such sum of money
as they may ascertain from the different supervisors, for the re-
pair of the public roads in said county, and to be collected as
other county charges are.
6. And be it enacted, That it shall be the duty of each super-
visor to call on the taxable persons within his district, at least
two days before he intends working on said roads, and to notify
them of his intentions, and the. place of meeting, whose duty it
shall be to furnish one half of their able bodied male hands, if
required, except in time of wheat harvest, under the penalty of
sixty-seven cents for every hand so required, to be recovered
before a magistrate as other small debts are recoverable in this
state, and returned by the said supervisor to the levy court, to be
applied as they shall direct.
7. And be it enacted, That for the purpose of regulating and
establishing wages for labourers, carts and team, the said super-
visors may employ able bodied male hands to work on the said
roads, at the rate of sixty-seven cents per day, and for cart and
team hauling dirt, timber or other materials necessary for the
repair of the public roads, the sum of one dollar per day; and
for every day which each supervisor shall necessarily attend on
said roads as supervisor, he shall be entitled, to a sum not exceed-
ing one dollar and fifty cents per day.
8. And be it enacted, That if any of the supervisors appointed
by this act, shall not sufficiently clear, amend, and keep in good
order and repair, the public roads within his district, or shall
suffer any fallen trees, or other obstructions, to remain in or across
any of the said public roads, whereby any cart, wagon, or other
carriage, may be obstructed for more than three days together,
he having notice thereof, or shall neglect to fall all dead trees on
either side of the said public roads, whose limbs hang over, and
may by their falling injure travellers, or to lop or cut off all
limbs or branches of trees hanging or projecting over the road,
within fifteen feet above the surface thereof, or shall suffer any
of the bridges or causeways to be out of repair, (except framed
