3. And be it enacted, That the orphans court aforesaid be, and
are hereby authorised and empowered, on application of the said
trustee, to direct and order the terms and conditions of the sale
of said laud, and to decree the application of the proceeds thereof,
us to them shall appear proper.
4. And be it enacted, That the bond which the said trustee shall
enter into for the due and faithful performance of his trust as

aforesaid, shall be liable and answerable for all and every matter
and thine; directed and required to be performed by said trustee
in virtue of this act.
5. And be it enacted, That the said trustee shall make report,
on oath, and render a just and true statement of his proceedings

in the premises, to the orphans court aforesaid, and on his ne-
glect to do so, his bond as trustee shall be answerable for any
damage occasioned by such neglect; and the orphans court
aforesaid may allow the trustee such compensation for his trouble
as to them shall appear proper and reasonable.
6. And be it enacted, That if the said trustee shall die before
the several trusts reposed in him by this act are completed and
discharged, then the orphans court aforesaid shall appoint some
fit and proper person trustee in his place and stead, who shall

give bond in such penalty, and with such security, as the said
court shall prescribe and direct, conditioned for the due and faith-
ful performance of the trusts and duties required of and imposed
on him by this act, and the orders of the orphans court aforesaid,
which bond shall be recorded in the said court, and on an attested
copy thereof suit may be maintained by any person interested;
and such trustee, so to be appointed, shall have all the powers,
and be subject to the orders and controul of the orphans court
aforesaid, in the same manner as the trustee named in this act.
7. And be it enacted, That if the aforesaid John Douglass
Freeman should die before he shall arrive at the age of twenty-
one years, the proceeds of the lands shall descend in the same
manner as the land would have descended if the same had not
been sold.

CHAPTER 235.

An act to Incorporate a Company to make a Turnpike
Road from the contemplated Bridge over the River Sus-
quehanna, at Conowingo Creek, to the Pennsylvania

line.
Sec. 1. Be it enacted by the General Assembly of Maryland, That
a company shall be incorporated to make a turnpike road from
the contemplated bridge over the river Susquehanna, at Cono-
wingo creek, to the Pennsylvania line, in a direction towards New-
London Cross Roads.
2. And be it enacted, That subscription books shall be opened
on or before the first day of May next, at Belle-Air, in Harford
county, at Bald-Friar, and at the Rising Sun, in Cecil county,
and at Oxford, in Chester county, Pennsylvania, for a capital
stock for said company of twenty-four thousand dollars, in
shares of twenty dollars each, under the direction of the follow-
ing commissioners, to wit: At Belle-Air by John Forwood, Tho-
