9. AND BE IT ENACTED, That it shall be lawful for
any corporation or body politic in the United States to become
stockholders in said company,
10. AND BE IT ENACTED, That if said company do
not proceed to carry on said work within two years after the
first Monday of January eighteen hundred and nineteen, or
shall not within ten years thereafter complete the said road, it
shall be lawful for the legislature of this state to resume the
rights, privileges, liberties and franchises granted by this act
to said company.
11. AND BE IT ENACTED, That the county court of
Frederick county shall appoint five commissioners, who shall
estimate the amount of the damages sustained by any person or
persons by reason of said road passing through his, her, or
their land, or by taking stone, Gravel, or ether materials, for
the use of said road, in eases where the parties cannot agree ;
which estimate shall be final in determining such damages.
18. AND BE IT ENACTED, That no toll gate shall be
put up within one mile of Westminster, or within one mile of
Liberty Town.

CHAPTER 92.

An act to authorise Philemon Towson and Sebastian Graff to
sell and dispose of certain property in the City of Balti-
more, belonging to them and their infant children.
Sec. 1. BE IT ENACTED by the General Assembly of
Maryland, That Philemon Towson and Sebastian Graff or the
survivor of them, be and they are hereby appointed trustees
and are authorised and empowered to sell and dispose of a
house and two lots of ground lying on Charles and North
West streets in the city of Baltimore, formerly owned by John
Cocksy deceased, in such manner and on such terms as the
chancellor shall direct, and the money arising from the sale
alter deducting all legal and necessary expellees, shall be in-
vested by the trustees under the direction of the chancellor, in
some productive stock or other good security for the use and
benefit of the parties interested, securing to each of them there-
in an interest equal to and according to the same ratio as that
they respectively had in the property and premises so ordered
to be sold.
S. AND BE IT ENACTED, That the said trustees or
the survivor of them be, and they are hereby authorised to sur-
vey, lay out and divide the said property in such manner, and
to sell the same in such parcels as they may deem most desira-
ble.
3. AND BE IT ENACTED, That before the said Phile-
mon Towson and Sebastian Graff proceed to act as trustees
aforesaid by virtue of this act, they shall enter into bond to
the State of Maryland, with such securities, and in such sum
as the chancellor may order, conditioned for the faithful per-
formance of the trust reposed in them by this act, which said
bond shall be filed and recorded in the office of the chancery
court, and any person interested in the execution of this trust
may put said bond in suit for their use, and a certified copy of
said bond shall in any such suit be received in evidence in the
same manner as the original bond might or could be.
