Provisos.

law, or according to the act or assembly or words to that ef-
fect although it does not appear that the same were made by
such femes covert on private examinations, or out of the
presence and hearing of their respective husbands, shall be and
the same are hereby declared to be, of the same validity and
effect to pass the property and estate limited and expressed
therein, as if such acknowledgment had been taken and certi-
fied in the manner heretofore required by law; Provided that
nothing herein contained shall affect the decision of any suit
now depending, or any case wherein a judgment hath been ob-
tained, or when any person or persons having executed such
defective deed, or those claiming under them are now in pos-
session of the property; Provided also, that whenever it shall
appear that there has been surprise or mistake or fraud in ob-
taining such deed or acknowledgment, this law shall not operate
to make good such deed.

CHAPTER 72.

An additional supplement to the act to regulate public ferries.
Sec. 1. BE IT ENACTED by the General Assembly of
Maryland, That from and after the passage of this act it shall
and may be lawful for the different county courts of this state,
upon the conviction or any licensed ferry-keeper for the non-
performance of his duties, to fine such ferry keeper at their
discretion, any sum of money not exceeding one hundred dol-
lars, in each and every case.

CHAPTER 73.

An act to provide for the appointment of commissioners for the
regulation and improvement of Princess Anne, in Somerset
County.

Sec. 1. BE IT ENACTED By the General Assembly

Maryland, I hat five judicious and discreet persons, residing
in the town or precincts of Princess-Anne, shall be elected by
ballot, in the month of March, eighteen hundred and sixteen
at the courthouse in the said town, by the free male white
house keepers or heads of families, residing in the said town
or precincts, or such persons holding real property therein ;
and the five persons who shall appear to have the greatest num-
ber of votes at the close of the election, shall be declared to be
duly elected the commissioners of the said town and precincts
and shall have and exercise the several powers and authority
delegated to them by this act.
2. AND BE IT ENACTED, That the commissioners
so chosen shall assemble on the first Monday in April next en-
suing their election, or as soon thereafter as may be conveni-
ent, at the court house in the said town, and arrange and num-
ber themselves into five classes, by lot, and the office of the
commissioner of the first class shall determine at the expiration
of one year after his election, the office of the commissioner of
the second class at the expiration of two years, the office of
the commissioner of the third class at the expiration of three
years, the office of the commissioner of the fourth class at the
expiration of four years, and the office of the commissioner of
the fifth class at the expiration of five years; and the vacancy
thus successively occasioned by the determination of their res-
pective offices shall be supplied by the election of a judicious
