the mouth of Samuel Owing's lane, and thence running until it
intersects another public road near Richard Owing's smith's
shop, and the same when so surveyed and a plat thereof return-
ed to Baltimore county court, to be recorded among the land
records thereof, be and the same is hereby declared to be a pub-
lic highway forever thereafter, and shall be kept in repair as
other public roads in said county.

CHAPTER 45.

An act for the benefit of the heirs of John Stevens deceased,
of Worcester County.
Sec. 1. BE IT ENACTED by the General Assembly of
Maryland, That the orphan's court of Worcester county be,
and they are hereby authorised and empowered, if they think
it will be advantageous to the heirs of John Stevens late of
Worcester county deceased, to appoint a trustee to sell and
dispose of their interest and title in and to the mills known by
the name of the Nassongo mills, and the lands and lots thereto
adjoining in Worcester county, at such time and upon such
terms as shall be prescribed by the said orphan's court, and that
upon the payment of the whole purchase money, the said trus-
tee shall convey the said real estate to the purchaser or pur-
chasers, which conveyance being duly made shall be sufficient
to convey all right, title, claim and interest of in and to the
said real estate, which the said John Stevens had at the time of
his death, and which descended to his children.
2. AND BE IT ENACTED, That the trustee, to be ap-
pointed by the said orphan's court, before he proceeds to exer-
cise any of the powers to be vested in him by virtue of said ap-
pointment, shall give bond to the State of Maryland, in such
penalty and with such security as the orphan's court of said
county shall direct, for the faithful performance of all and sin-
gular the powers by this act directed to be vested in him, which
bond shall be recorded by the register of wills for said county,
and the same or an office copy thereof may be put in suit by
any person or persons interested in the performance of the con-
dition of the same; Provided always, AND BE IT ENACT-
ED, That no sale made by the trustee aforesaid by virtue of
this act shall be good and valid until the same be approved of
by the orphan's court aforesaid; and in case such sale shall be
rejected by the said court, the said trustee shall proceed to sell
again, and so from time to time until such sale shall be approv-
ed of by the said orphan's court.
3. AND BE IT ENACTED, That the said orphan's court
be, and they are hereby authorised and empowered to ascertain
the proportion of the proceeds of the sale of the said real estate
which the widow of the said John Stevens shall have for her
dower in the same, not more than the sixth nor less than the
eighth thereof; and the said orphan's court are further author-
ised empowered and directed to have the balance of the pro-
ceeds of said sale after deducting the widow's dower and expen-
ces, invested in some safe and productive fund for the benefit
of the heirs of the said John Stevens; or if the personal estate
of the said John Stevens shall be insufficient to pay his debts,
the judges of Worcester county court are hereby empowered
on a bill filed by any creditor or creditors of said John Stevens,
to decree that the nett proceeds of said sale shall be applied in
