children of said Henry Willis, shall be equally divided among
the children of the said Willis, and if any of the said children
should die before arriving at the age of twenty one years and
leaving no issue, that then and in that case the portion or por-
tions of said child or children, shall be equally divided among
the surviving children of the said Willis, in the same manner
as the said lands would- have descended if the same had not
been sold; Provided always, that before the division of said
surplus money, among the children of the said Henry Willis,
by the said trustees, the chancellor shall appropriate out of said
surplus money, such part or portion of it as in his judgment
shall be adequate to the maintenance of the aforementioned Ho-

ner Willis, the mother of said Henry Willis, which part or
portion of said surplus money shall be in lieu of all and
any claim, of the said Honer Willis, in and to the lands
hereby authorised to be sold by the aforesaid trustees.

CHAPTER 41.

An act for the relief of the devisees of Thomas McCreery.
Sec. 1. BE IT ENACTED by the General Assembly of
Maryland, That all the right and title which the State of Mary-
land now hath by escheat in and to the property devised by
the will of said Thomas McCreery, shall be and hereby is re-

linquished and released for the benefit of the devisees therein
named, and that the legal title in all the said property shall be
and hereby is vested in Nicholas Brice, his heirs, executors,
administrators and assigns in trust, to sell the same and apply
the nett proceeds thereof, under the direction and superinten-
dance of the orphan's court of Baltimore county as is directed
by the said will, and the said orphan's court are hereby author-
ised to direct the terms and manner of said sale, to ratify or
reject the same, to allow reasonable commission to said trus-
tee for his expense and trouble, and make distribution of the
nett proceeds of said sale agreeably to the said will, and in case
of the death of said trustee to appoint another fit person to act
as trustee in the premises.
2. AND BE IT ENACTED, That before the said trustee
proceeds to make any sale, be shall give bond to the state of
Maryland to be approved by and filed with the said orphan's
court, in such penalty as said court shall direct, conditioned
for his faithful performance of the trust aforesaid.

CHAPTER 42.

An act repealing the fourth section of an act entitled, an act to
incorporate a company to make an artificial road by the
nearest and best rout from the Philadelphia and Lancaster
turnpike road, through the village of Strasburgh in Lancas-
ter county, to the Susquehanna triage at McCalls ferry, and
from thence to the City of Baltimore.
Sec. 1. BE IT ENACTED by the General Assembly of
Maryland, That the fourth section of an act entitled, an act
to incorporate a company to make an artificial road by the near-
est and best route from the Philadelphia and Lancaster turn-
pike road, through the village of Strasburgh in Lancaster
county, to the Susquehanna bridge at McCall's ferry, and from
thence to the city of Baltimore, in the words following to wit:
