Bond.

tion of the orphans' court of Alleghany county,) be in-
vested in such manner as said court shall direct
3. AND BE IT ENACTED, That the said trustee
before the proceeds to act under the provisions of this
act, shall give bond with such security as shall be appro-
ted of by the judges of the orphans' court aforesaid,
conditioned for the faithful performance of the trust re-
posed in her by this act, with such penalty as the said
court shall direct.

Decent in case
of death.

4. AND BE IT ENACTED, That if either of the
said infant children of the said John Payne deceased,
shall die intestate before they arrive at the age of twenty
one years, then the money arising from the sale of the
land before mentioned, shall descend and pass in the same
course of descent as the said lands would have passed or
descended if this act had not passed.

CHAPTER 75.

An additional supplement to the act entitled, an act for
establishing a company for opening and extending the
navigation of the river Potomack.
SEC. 1. BE IT ENACTED By the General Assembly
of Maryland, That the Potomac company, by their pre-
sident and directors, their successors or a majority of
them, shall be and they are hereby authorised and em-
powered to use and dispose of the land and water
rights, now held by the said company, or which they
may hereafter acquire in this state, in the erection of
mills or other water works on account of the said com-
pany, and may use, sell or dispose of the same when
erected, or may lease, sell and convey such land and
water rights in such manner and upon such terms as to
the said president and directors and their successors or a
majority of them may appear most advantageous for the
interests of the said company; and shall be authorised
and empowered to acquire lands and other property con-
tiguous to the canals and locks on said river, by purchase,

compromise or exchange; Provided that said company
shall not at any time hold more than one thousand acres
of land in this state, and provided that nothing herein
contained shall be considered to authorise any act or bar-
gain on the part of the said president and directors which
shall in its consequences impede, retard or injure the
navigation of the said river, canals or locks.

Deeds and
conveyances.

2. AND BE IT ENACTED, That all deeds and
conveyances under contracts therefor, authorised by
the said president and directors and their successors or a
majority of them in virtue of the provisions of this act;
shall be acknowledged by the president as such in behalf
of the said company under his hand and seal, and be exe-
cuted and recorded as other deeds are by law directed to
be acknowledged, executed and recorded.
