sioners, or a majority of them shall value and ascertain
the damages that may be sustained by each and every of
the persons, through or on whose lands the said road
may pass (petitioners to the general assembly for this
road only excepted) by opening the same, and the dama-
ges so ascertained shall be levied and assessed as other
county charges are, and shall be paid over to the said
persons respectively over whose land said road may
pass.

4. AND BE IT ENACTED, That the said commis-
sioners before they proceed to act, shall take an oath be-
fore some justice of the peace , that they will, without
favor or affection, prejudice or partiality, assess the da-
mages sustained by the person or persons through whose
lands the said road may pass, by reason of opening the
same.

5. AND BE IT ENACTED, That the said commis-

sioners respectively, when named by the levy court as

aforesaid, shall be entitled to receive two dollars for
every day they shall severally attend to discharge the du-
ties required by this act, which is hereby directed to be
levied, collected and paid, as other county charges are le-
vied, collected and paid.

CHAPTER 99.

An act for the payment of the Journal of Accounts.
WHEREAS it appears by the journal of accounts
of this session, that there is due from this state the sum
of twenty seven thousand two hundred and fifty four
dollars; Therefore,

Preamble.

Sec. 1. BE IT ENACTED by the General Assem-
bly of Maryland, That the treasurer of the western shore
be and he is hereby authorised and required to pay the se-
veral persons, their executors, administrators, assigns
or orders, or to such of them as shall offer to receive the
same, the several sums of current money allowed to
them respectively as they appear to be settled and ascer-
tained by the said journal of accounts, out of money now
in the treasury or that shall come into the treasury, sub-
ject to the appropriation of the general assembly.

CHAPTER 100.

A further supplement to the act entitled, "An act for o-
pening and extending Aisquith Street in the eastern
precincts of Baltimore.
SEC. 1. BE IT ENACTED by the General Assembly
of Maryland, That the collector of taxes of the city of
Baltimore, for the time being, shall have authority to col-
lect by distress or otherwise, from all persons chargea-
ble therewith, their respective proportions of the dama-
for opening and extending said street, as ascertained
by the commissioners appointed by the mayor of said
city, in virtue of the supplement, passed at the last ses-
