capital expended, and that it is the interest of all con-
cerned to sell the same, and have prayed that a law may
pass giving them power to sell the property mentioned in
the said petition, and divide the money arising from such
sale in the manner proposed in the said petition, which to
this General Assembly appears reasonable, expedient and
beneficial to the infants interested in the said property;
Therefore,

Dec. Sess.
1813.

Section 1. BE IT ENACTED by the General Assem-
bly of Maryland, That the petitioners or a majority of
them are hereby empowered to nominate and appoint
under their hands and seals any one of the petitioners as
a trustee to sell the said property in the said petition
mentioned for the benefit of the whole of the persons in-
terested therein, and to divide the proceeds of such sale
among the present owners of the same, in due propor-
tions according to their respective interests therein.

2. AND BE IT ENACTED, That such trustee
when so appointed shall have full power and authority,
(first giving three weeks notice in seme public news-pa-
per printed in the city of Baltimore,) of the time and place
of sale, to sell the said lot and premises at public sale to
the highest bidder, on a credit of six and twelve months,
the purchase money to bear interest from the day of
sale, and upon the payment of the purchase money and
interest as aforesaid and not otherwise, to convey the
same to the purchaser in fee simple, which conveyance
shall puss the interest in the same of the infant heirs, de-
visees or representatives of John O'Donnell, James Dall
and Jeremiah Yellott in the said petition mentioned or
either or any of them as effectually and to all intents and
purposes as if the said infants and every of them were
of full age and had joined in the said conveyance.

3. AND BE IT ENACTED, That before the said
trustee shall proceed to execute the said trust, he shall
give bond to the state of Alary and, with security to be
approved of by the orphans' court of Baltimore county,
in the penal sum of twenty thousand dollars, conditioned
for the faithful performance of the duties reposed in him
by this act, and that he will well and truly divide and
distribute the sum or sums by him received from the
sale of said house and lot, among the several persons
entitled to receive the same, according to their respective
interests therein; which said bond shall be filed in the
office of the register of wills fur Baltimore county, there
to be recorded, and upon an office copy of which, suit or
suits may be instituted in the name of the state of Mary-
land for the use of any person or persons interested therein.
