before him by the oath of any credible person that an offence has
been committed against the provisions of this act by driving any
carriage, wagon, vehicle of any description, or by riding or driving
any horse over the paved footways of said town, to issue his war-
rant against the offender directed to some constable of the Cum-
berland Hundred, and returnable before himself or some justice
of the peace resident within the town of Cumberland, and named
in said execution, whose duty it shall be to arrest, and carry such
offender before the justice before whom the warrant is returnable,
and such justice upon proof of the commission of such offence by
such person, shall give judgment against him for the said fine,
and costs, upon which the same proceedings shall be had in the re-
covery and application of said fine and costs, as are above directed
in cases of arrest by a constable upon view of the offence.

4. And be it enacted, That nothing in this act, shall in any wise
affect or impair any proceedings had under the said law and its
supplements before the passage of this law, or to take away the
power of collecting any taxes already imposed or of appropriating
the monies already collected, or such as may hereafter be collected
under levies made before the passage of this law; and any bailiff
or bailiffs into whose hands any levy list may have been placed by
the commissioners of said town, before the passage of this act, for
collection, shall have power, and they are hereby authorized and
required to collect the monies thereby assessed, and to render an
account of and pay the same over to the persons who are the com-
missioners of said town, at the time of the passage of this act, in the
same manner and under the same penalties as they were authorized
and required before the passage of this act to collect, render an
account of, and pay over taxes collected by them, and the said
commissioners are hereby authorized and required to pay out of the
corporate funds already in hand, or which may hereafter come to
their hands, all the corporate debts already incurred, and after pay-
ment of the same to expend the residue within the limits of said
town in making such improvements and repairs as they may deem
most advantageous to its citizens, and to expend it on the sections
of said town east or west of Wills creek, in the proportion of the
amount collected from those sections.

CHAPTER 131.

A supplement to an act entitled, An Act to regulate Lotteries.
Be it enacted by the General Assembly of Maryland, That so
much of the act entitled, An Act to regulate lotteries, as author-
izes the Governor and Council, to appoint two additional com-
missioners of lotteries, be, and the same is hereby repealed.

CHAPTER 132.

An act for the re-valuation of the real and personal property in Frederick
County.
Sec. 1. Be it enacted by the General Assembly of Maryland,
That the commissioners of the tax for Frederick county, be, and
they are hereby authorized and empowered to meet at Frederick
Town as soon as may be practicable after the passage of this act;
and they or a majority of them are hereby empowered and direct-
