4. And be it enacted, That the stockholders in said company, be,
and they are hereby treated and erected into a body politic and
corporate, by the name and style of the president, managers and
company of the Hunting Ridge Turnpike Road, and by the same
name have perpetual succession; and all the privileges and franchi-
ses incident to a corporation, and shall be capable of suing and be-
ing sued, answering and being answered, and of enlarging their
stock by new subscriptions if the same shall be found necessary.

5. And be it enacted, That the president and managers, be, and
they are hereby authorized to require and demand that the sums
subscribed shall be paid to them in the manner following: that is
to say, one half part thereof (including the five dollars per share
paid to the commissioners at the time of subscribing,) at the
end of one month after the said first election; one fourth at the end
of two months after said first election; and the other fourth part in
four months after the saint election, or so much thereof as may be
necessary to complete the said road.

6. And be it enacted, That the president and managers, be, and
they are hereby authorised to appoint five commissioners, who, or
a majority of them, shall examine the course and location of the
said road as herein before described, and shall make a plot of the
same, specifying the courses and distances, and return the same
to the clerk of Baltimore county court, to be recorded; and said
commissioners, before they proceed to act, shall take the follow-
ing oath or affirmation: I. A. B. do swear or affirm, that I will lav-
out and mark the Hunting Ridge Turnpike Road, according to the
best of my skill and judgment; and according to the direction of an
act of Assembly, entitled an act to incorporate a company to make
a turnpike road from the intersection of the Baltimore and Frede-
rick Town Turnpike Road near the third mile stone on said road, to
McVille, in Baltimore county; and I do further swear or affirm,
that I am not interested in any land through which said road is
likely to pass.

7. And be it enacted, That the said company shall open said
road hereby contemplated to be made, according to the location
aforesaid, thirty feet wide, of which at least fifteen feet shall be an
artificial road, composed of stone gravel, wood or other materials
compacted together a sufficient depth to secure a solid foundation
to the same; and said road shall be faced with gravel or stone
pounded, or other small hard substance, in such manner as to se-
cure a firm, and as near as the materials will reasonably admit,
an even surface, and so nearly level in its progress as that it shall
in no place rise or fall more than will form an angle of five degrees
with a horizontal line; and shall also erect and keep up bridges and
culverts over the streams crossing the same, and they shall also
from time to time keep the said road in good order and repair; and
when the said road shall be perfected, said company shall be en-

tled to tolls after the year eighteen hundred and thirty-seven, un-
