CHAPTER 168.

An act to authorise the building of a bridge over the River Patapsco at the
place called Hammonds Ferry.
Sec. 1. Be it enacted by the General Assembly of Maryland,
That Samuel I. Donaldson, of the city of Baltimore, and Ca-
milla Almeria Donaldson his wife, their heirs or assigns shall hove
full power and authority, at any time within five years hereafter
to build and erect at their private expense, a cause way and bridge,
over the river Patapsco, at a place commonly called Hammonds
Ferry, which bridge when erected, shall be of sufficient width for
all carriages to pass over the same; and that when said bridge
shall be erected, it shall and may be lawful for the said Samuel I.
Donaldson, and Camilla Almeria Donaldson his wife, their heirs
and assigns for ever thereafter to ask, demand and receive as toll
for passing over said bridge, according to the following rates, to
with for each foot passenger, five cents; a man and horse, ten certs; for
every two wheeled pleasure carriage and driver, twenty-five cents;
for every other two wheeled carriage or cart and driver, twenty cents;
four wheeled carriages and driver, with two horses, thirty seven and
half cents; with four horses, fifty cents; a horse without a rider,
six cents; horned cattle, four cents each; and sheep and hogs each
two cents; for each passenger (other than the driver) in any cart,
wagon or carriage, five cents; provided always, and it is the true
intent and meaning of this act, that the said Samuel I. Donaldson,
and Camilla Almeria Donaldson his wife, their heirs and assigns
shall not be permitted, in virtue of the power hereby vested in them,
to obstruct, or in any manner impede the passing and repassing of
vessels of any size or description in said river, at the place afore-
said; but the said Samuel I. Donaldson, and Camilia Almeria Don-
aldson, their heirs or assigns, shall be obliged to have a free pas-
sage kept open for the same, either by draw bridge or other-
wise.

Authorised
to sell, &c.

2. And be it enacted, That the said Samuel I. Donaldson, and
Camilla Almeria Donaldson, his wife, their heirs or assigns, shall
have full power and authority to sell the land on both sides of the
river Patapsco, at the said place, called Hammonds Ferry, with
the privilege hereby granted to any person or persons, or body cor-
porate, now in existence, or hereafter to be created, who, on ma-
king a purchase of said lands and privilege shall be entitled to all
the benefits of this ait.

Penalty if out
of repair.

3 And be it enacted, That should the said bridge be suffered to
become out of repair, so as to render the said bridge dangerous
or impossible to be passed and repassed, except when the same
may be undergoing repair, the owner or owners thereof shall be
liable to be indicted therefor, either in Baltimore or Anne Arun-
del county court; and upon conviction, shall be liable to a fine in
the discretion of said court in which the said conviction may be
had, in a sum not exceeding one hundred dollars, and the costs of
prosecution.
