CHAPTER 72.

An act to provide f6r the widening of Cheapside-street in the city of Baltimore.
Sec. 1. Be it enacted by the Central Assembly of Maryland, That
William Jenkins, Richard H. Jones, Christopher Raborg, James
Cheston, William Jessop, Rosetter Scott and Charles Worthington,
or a majority of them be, and they are hereby appointed commission-
ers with full power and authority to widen Cheapside-street, lay out
and survey all that private property in the city of Baltimore in front
and between the houses on Cheapside and Cheapside dock, from Wa-
ter-street to Pratt-street, to be added to Cheapside-street, and cause
two plats to be made, designating the owner or owners of said pro-
perty on the plats, and shall return under their hands and seals one
of the plats to be lodged in the office of the Register of the city of
Baltimore, there to remain as part of the said city; and the other plat
to the office of the clerk of Baltimore county court to be by him pre-
served among the records of said court.

their duties.

2. And be it enacted, That the said commissioners after having Sur-
veyed the ground and designated each and every owner of said pro-
perty on the plats, shall proceed forthwith to ascertain and determine
the value of each and every owner of said property shall be that is to
be added to Cheapside street, returning a list of the owners and the
value of each one's property with the plats aforesaid, and having as-
certained the value aforesaid and added thereto five per cent commis-
sion to the collector, and an estimate of the expences of executing
their agency of two dollars per day including a reasonable compensa-
tion to their surveyor and clerk, whom they are hereby authorised to
employ they shall then proceed to assess the said amount upon the
property benefitted by the widening of the said street, and having com-
pleted the said estimate and assessment the said commissioners shall
make a full and particular report thereof to the Register of the city of
Baltimore.

Value and
assessments.

3 And be it enacted, That the sums assessed upon the property
benefited shall be a lien upon the same, and shall be collected by the
City Collector in the same manner and with the same power as the
collection was made in the benefitted property in the act for extend-
ing Pratt-street,and in like manner shall be paid over by him to the
Mayor and City Council of Baltimore, and by them to the persons en-

titled to receive the same.

4. And be it enacted, That the Mayor and City Council of Balti-
more, within thirty days after the completing and return of the com-
missioners for adding the property in front of the houses on Cheap-
side to Cheapside-street, are authorised and required to cause the
grade of said Cheapside-street from Water to Pratt-Street including
the property added by this act to be done and that they shall have the
same filled up complete in all respects and paved within four months
after the return of the commissioners aforesaid, and said street when
so completed shall be a public highway for ever: Provided, that noth-
ing shall be done by said commissioners in pursuance of the provi-
sions of this act, unless with the approbation and consent of the May-
or and City Council of the city of Baltimore expressed by an ordi-

nance to be passed by them for that purpose.

5. And be it enacted, That the act entitled an act to provide for the
grading of the streets therein mentioned, passed December session,
eighteen hundred and eighteen, chapter one hundred and ninety-
eight be, and the same is hereby repealed.
